RESOLUTION NO. 93-23 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING AN EXTENSION OF CONDITIONAL USE PERMIT NO. 132 TO ALLOW THE CONTINUED USE OF THE MIRALESTE ELEMENTARY SCHOOL SITE BY VARIOUS INDIVIDUALS, EDUCATIONAL, AND COMMUNITY ORGANIZATIONS LOCATED AT 6245 VIA CANADA. WHEREAS, on December 8, 1987, the Planning Commission of the City of Rancho Palos Verdes approved Conditional Use Permit No. 132 to allow the Miraleste Elementary School site to be used by various individuals and community organizations; and, WHEREAS, on April 9, 1991, the Planning Commission of the City of Rancho Palos Verdes approved Conditional Use Permit No. 132 - Revision "A" to allow use of the site by the Discovery World Infant Center and Preschool; and, WHEREAS, on May 14, 1991, the Planning Commission of the City of Rancho Palos Verdes approved a two (2) year extension to Conditional Use Permit No. 132 to allow the continued use of the Miraleste Elementary School site by various individual and community organizations; and, WHEREAS, on December 8, 1992 the Planning Commission of the City of Rancho Palos Verdes approved an extension to Conditional Use Permit No. 132 - Revision "A" to allow the continued use of the site by the Discovery World Infant Center and Preschool until May 14, 1993, at which time any requests for extension would be reviewed at the same time and in conjunction with the master Conditional Use Permit for the entire site; and, WHEREAS, the Palos Verdes Peninsula Unified School District has submitted a request to extend the master Conditional Use Permit for the entire site, including uses approved through Revision "A"; and, WHEREAS, on May 25, 1993, the Planning Commission of the City of Rancho Palos Verdes considered the request to extend Conditional Use Permit No. 132, including all revisions, and directed Staff to provide additional information and to notice all adjacent property owners of the request to extend the permit; and, WHEREAS, on August 24, 1993, the Planning Commission of the City of Rancho Palos Verdes conducted a public hearing, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The subject uses on the site have been operated in compliance with all related conditions of approval and that no complaints regarding the uses on the site have been received by the City. Section 2: That the site is adequate in size and shape to accommodate the existing uses since the site is 6 acres in size and the uses are no more intensive than the previous elementary school uses. Section 3: The site is related to streets and highways properly designed to carry the type and quantity of traffic generated by the use in that the site is bounded by Palos Verdes Drive East, Via Canada, and Picardie Road which are public streets and a total of 51 on-site parking spaces are available to accommodate the approved uses on site. Section 4: The use is not contrary to the General Plan since it provides valuable community services at a convenient location and allows community use of the grounds. Section 5: For the foregoing reasons and based on information and findings included in the Staff Report and records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves an extension to Conditional Use Permit No. 132, subject to the conditions of approval contained in Exhibit "A", which are necessary to protect the public health, safety, and welfare. Resolution No. 93-23. Page 2 of 5 EXHIBIT "All CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT NO. 132 - EXTENSION 6245 VIA CANADA A. CONDITIONS PERTAINING TO ALL USES ON THE SITE 1. unless specifically addressed herein or revised in subsequent actions, all conditions of approval for Conditional Use Permit No. 132, including any revisions and as detailed in P.C. Resolution Nos. 87-76, 89-50, 89-74, 90-16, 91-11, 91-20, 92- 3, 92-4, 92-75, are hereby incorporated into this document and shall remain in effect. 2. This approval shall be valid until November 24, 1997. The landowner may request, in writing and with the appropriate fee, that the Planning Commission extend this permit prior to its expiration. 3. This extension applies to all currently existing uses on the site. The landowner shall notify the City upon any change in tenancy or change in use by any of the current tenants. No subleases shall be permitted. Any change shall be subject to review and approval by the Director of Environmental Services. The following is a list of current tenants and leased rooms: a. Discovery World Infant Center and Preschool - Rooms 1, 2, 4, 8, 9, 10, Multi-purpose room and Administrative offices b. Altamira Editions (Nina Kan - artist) - Room 7 C. Los Angeles Community College District (Mommy and Me program) - Room 3 d. Peninsula School of Performing Arts (dance) - Rooms 11, 12 e. Rooms 5 and 6 are currently vacant 4. A maximum of two (2) teacher parking spaces shall be permitted only after 6:00 p.m. within the southwest portion of the loading zone (located to the left of the bollards) located between Buildings 1 and 5. No other parking or loading shall be permitted at any time either in the southeast portion of the loading area or along the driveway leading to the rear parking lot. 5. No new uses shall be approved which, in combination with other approved uses on the site, result in an inadequate number of parking spaces available to accommodate all uses on the site. P.C. Resolution No. 93-23. Page 3 of 5 6. Pursuant to Condition No. 2 of P.C. Resolution No. 92-4, pavement striping and signage within the loading zone area shall be maintained to prevent parking at all times within the southeast portion of the loading zone. 7. No identification signs shall be placed on the site without prior review and approval of a comprehensive sign program for the entire site by the Director of Environmental Services. Such a program shall include a plan for signs which are consistent in design, color, and materials and shall specify the proposed location and height of signs. 8. This approval may be suspended by the Director of Environmental Services if any use of the site is found to be in violation with any of these conditions of approval. 9. Within thirty (30) days of this approval, the landowner shall submit, in writing, a statement that they have read, understand, and accept all conditions of approval. Failure to provide such a statement shall render this approval null and void. 10. In order to reduce the number of vehicle trips to and from the site, the landowner shall work with all tenants using the site, including their employees and students, to encourage carpooling wherever possible. 11. Trash dumpsters shall be located so that they are not visible from the street or adjacent properties. 12. The property shall be continuously maintained so as to meet the following minimum standards: a. All structures shall be painted, and all painted surfaces, including doors or other surfaces, shall be maintained free of dirt, graffiti, cracks, chips, or other visible surface flaws. b. All doors shall be maintained in working, weather -tight, and lockable conditions. C. All windows shall be maintained in a working, weather- tight and lockable condition, with no broken glass or substituted wood panels. d. The tile roof shall be maintained in a weather-proof and structurally sound condition. P.C. Resolution No. 93-23. Page 4 of 5 e. The grounds surrounding the structures, including but not limited to, paved and landscaped play areas and parking areas, shall be maintained in a clean, litter, and weed free condition. All landscaped areas shall be properly maintained to prevent vegetation which is unsightly due to lack of water or inadequate spraying, trimming, treatment, or similar maintenance. All lawn areas shall be regularly mowed, and all other landscaping shall be regularly trimmed to remove any overgrown, dead or dying vegetation. 8. CONDITIONS PERTAINING ONLY TO THE DISCOVERY WORLD INFANT CENTER AND PRESCHOOL. 1. The hours of operation shall be limited to Monday through Friday between the hours of 7:30 a.m. and 8:00 p.m., and Saturday between the hours of 10:00 a.m. to 3:00 p.m. 2. The gates providing access to the enclosed play equipment area may be locked when not in use by the Discovery World Infant Center and Preschool. Discovery World shall be permitted exclusive use of the enclosed play area during hours of operation. No future modification to the fencing shall be made without prior approval by the Director of Environmental Services. 3. The number of students enrolled in the Discovery World Infant Center and Preschool shall be established so that the number of parking spaces required for the use does not exceed twenty (20). This number shall be established based on State requirements for student to teacher ratios, and shall include allowances for a minimum of 5 loading spaces. If a change in the existing uses on the Miraleste Elementary School grounds occurs which causes additional parking spaces to be available, the applicant may submit a written request to the Diriector of Environmental Services to increase the level of enrollment.
