A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING EXTREME SLOPE PERMIT
NO. 34, THEREBY ALLOWING A 210 SQUARE FOOT PORTION OF
A DECK TO CANTILEVER SIX FEET OVER AN EXTREME SLOPE AT
3608 COOLHEIGHTS DRIVE.
WHEREAS, the applicants, Mr. and Mrs. John Peterson, have
requested an Extreme Slope Permit to allow a 210 sq. ft. portion of
a deck to cantilever six feet over an extreme slope, and;
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, (CEQA), the proposed project has been
found to be categorically exempt (Class III), and;
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearing was held on August
10, 1993, at which time all interested parties were given an
opportunity to be heard and present evidence:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section I:- That although the site can reasonably accommodate
the structure in another location not involving an extreme slope,
and, in fact, a portion of the deck will be located on the flat
portion of the rear yard, the applicants are trying to maintain the
remainder of the rear yard undisturbed for future improvements.
Section 2: That the permit will result in no significant
adverse effect on neighboring properties for several reasons. Due
to the stepping affect of the adjacent lots to the east, it is
Commission's determination that the proposed deck will not cause
any view impairment nor will it have any visual impact to the area.
The deck, as proposed, is not formidable is size or scale, and will
be sensitively located over the slope. The materials to be used
for the railing, transparent tempered glass panels with minimal
vertical support members, will further soften the appearance of
the deck. Additionally, the applicants are proposing minor
grading (excavation less than 20 cu. yds.) to step the deck
down from one end of the lot to the other, such that the spa (to
be located on the deck) will be at current grade level. Any
drainage issues will be addressed by the City's Building and Safety
Division.

Section 3: That there will be insignificant disturbance to
the slope since the deck will be cantilevered over the extreme
slope without any vertical support members.
Section 4: That the permit approval is not contrary to the
General Plan or Coastal Specific Plan since the General Plan
promotes improvements to properties that will enhance the visual
quality of existing neighborhoods while balancing and protecting
the rights of residents within those neighborhoods. It is the
Commission's opinion that the proposed deck is consistent with this
criteria. The subject property is not located within the City's
Coastal Zone.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff report, and records
of the proceedings, the Planning Commission hereby approves Extreme
Slope Permit No. 34, subject to the conditions contained in Exhibit
"All attached hereto and made a part hereof, which are necessary to
preserve and protect the public health, safety, and general welfare
in the area.
PASSED, APPROVED, AND ADOPTED this 10th day of August 1993.

EXHIBIT "A"
CONDITIONS OF APPROVAL FOR
EXTREME SLOPE PERMIT NO. 34
(3608 COOLHEIGHTS DRIVE)
•
1) The deck's maximum projection over the extreme slope
shall not exceed 6'-011.
2) The deck shall be located and constructed in substantial
conformance to the approved set of plans dated May 10,
1993.
3) Grading for any portion of the project shall not exceed
20 cubic yards, a height of fill no greater than three
feet or a depth of cut no greater than three feet .
4) Review for the proposed spa is not a part of this
approval.
5) A landscape plan shall be submitted to the Environmental
Services Department for review and approval by the
Director. Landscaping shall be incorporated on the slope
to screen the deck.
