RESOLUTION NO. 93-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 356 ALLOWING AN APPROXIMATELY 600 SQUARE FOOT DECK WHICH WOULD ENCROACH A MAXIMUM 14 FEET OVER AN EXTREME SLOPE; AND ALLOWING AN EXISTING SATELLITE DISH TO REMAIN ON AN EXTREME REAR YARD SLOPE FOR A PROPERTY LOCATED AT 26410 GRAYSLAKE ROAD. WHEREAS, the applicant, Zafar A. Basith, has requested a Variance to construct an approximately 600 square foot deck which would extend a maximum 141-011 over an extreme slope; and to allow an existing satellite dish erected without a permit to remain on an extreme slope; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on July 27, 1993, at which time all interested parties were given an opportunity to be heard and present evidence: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that the lot is of a substandard size, and only a small rear outdoor living area of approximately 1,647 square feet is available as useable recreational space due to the large portion of the lot which is extreme slope area. Section 2: The granting of the Variance is necessary to preserve a substantial property right of the landowner, (which right is possessed by other property owners under like conditions in the same zoning district) since the extreme slope on the property limits the use and enjoyment of the exterior portions of the rear property. Construction of the deck over the extreme slope will provide approximately 600 square feet of additional level area in the rear of the property, and will serve to provide for use of the property in a manner similar to that enjoyed by other property owners in the same zoning district. Section 3: The granting of the Variance would not be materially detrimental to the public welfare or injurious to property and improvements in the area, since the Conditions of Approval in the attached Exhbiit "All require that appropriate landscaping be planted to screen the deck as viewed from across the canyon and protect the privacy of the neighbors on either side of the property. The applicant will also be required to comply 0 with all Building and Safety Department specifications for the construction of the deck. Section 4: That the granting of such a Variance will not be contrary to the objectives of the General Plan nor the goals and policies of the Coastal Specific Plan since the residential use of the property will not be altered as a result of the deck; the project has been conditioned to protect the privacy of the adjacent properties; and the property is not located within the Coastal Zone. Section 5: That the site cannot reasonably accommodate the satellite dish in another location not involving an extreme slope. Section 6: That approval of the satellite dish in the extreme slope will not significantly adversely affect neighboring properties. Considerations leading to this determination included analysis of: view impairment, visual impact, slope instability, and increased runoff. The latter two considerations are subject to the review and approval of the Building and Safety Division. Section 7: That the installation of the satellite dish will create insignificant disturbance to the slope, subject to verification by the Building and Safety Division. Section 8: That the approval of the satellite dish is not contrary to the General Plan or Coastal Specific Plan, and that a specific allowance for such construction is set forth in the Development Code under Sections 17.41.200 and 17.57.060. Section 9: For the foregoing reasons and based on the information and findings included in the Staff Report and records of the proceedings, the Planning Commission hereby approves Variance No. 356 and Miscellaneous Hearing re: Satellite Dish, subject to the conditions contained in Exhibit "A" attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. Exhibit "All conditions of Approval Variance No. 356, and Miscellaneous Hearing Re Satellite Dish 26410 Grayslake Road The deck and satellite dish shall maintain the following minimum setbacks: Front: 201-011 Sides: 51-011 north 51-011 south Rear: 151-011 2. The maximum overall height of the deck (measured from the lowest adjacent grade to the top of the handrail) shall not exceed 141.-0ll; and the maximum overall height of the satellite dish shall not exceed 121-011. 3. The deck material shall consist of redwood, or a similar wood materials that blends with the natural landscape and is subject to review and approval of the Director of Environmental Services. 4. The applicant shall provide adequate landscaping to screen the support members of the deck, and to protect the neighbors' privacy from the deck. The satellite dish shall also be landscaped to mitigate its aesthetic impact. All landscaping shall be subject to the review and approval of the Director of Environmental Services. 5. All Building and Safety Department requirements must be met with regard to slope erosion, drainage, and any other specifications regarding construction into extreme slopes. 6. The applicant shall submit a Covenant to Protect Views to the Director of Environmental Services prior to submittal of plans to the Building and Safety Department for plan check. 7.
