A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES UPHOLDING THE APPEAL OF HEIGHT
VARIATION NO. 773, THEREBY APPROVING, SUBJECT TO ADD-
ITIONAL CONDITIONS OF APPROVAL, A 188 SQ. FT. LOWER
LEVEL ADDITION AND A NEW 1,815 SQ. FT. SECOND STORY THAT
WILL MEASURE 22'-6" IN OVERALL HEIGHT AT 3348 CORINNA
DRIVE.
WHEREAS, the applicants, Mr and Mrs. David Tabah have
requested a Height Variation to allow a 188 sq. ft. lower level
addition and a new 1,815 second story that will measure 22'-6" in
overall height, and;
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, (CEQA), the proposed project has been
found to be categorically exempt (Class III), and;
WHEREAS, the Acting Director of Environmental Services made
the determination that the revised project satisfied all of the
criteria set forth in Section 17.02.040 of the City's Development
Code, and approved Height Variation No. 773 on April 6, 1993, and;
WHEREAS, on April 21, 1993, within fifteen days of the Acting
Director's decision, Mr. Lawrence Clark filed a written appeal
accompanied by the appropriate fee, and;
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Development Code, a duly noticed public hearing was
held on June 8, 1993, at which time all interested parties were
given an opportunity to be heard and'present evidence, and;
WHEREAS, after deliberating over the information provided and
the testimony heard, the Commission continued the public hearing to
allow the applicants and the appellant an opportunity to reach a
resolution regarding the issue of invasion of privacy, and;
WHEREAS, on July 13, 1993, all interested parties were given
an opportunity to be heard and present evidence, and;
WHEREAS, on July 13, 1993, the Planning Commission directed
Staff' to prepare a resolution upholding the appeal, thereby
approving the project as modified with additional conditions of
approval.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the applicants complied with the Early
Neighbor Consultation process established by the City since they
obtained signatures from at least 60% of the property owners
located within 500 feet of the subject property stating that they
were informed about the proposed project.
Section 2: That the revised project is designed and situated
in a manner to minimize view impairment and does not create
significant view impairment from any surrounding properties since
the subject property is at an elevation which is significantly
lower than the homes on Deluna Drive.
Section 3: That the proposed project is not located on a
ridge or promontory.
Section 4: That the proposed project'does not impair a view
from public property which have been identified in the City's
General Plan.
Section 5:, That the revised project does not have the
potential for creating significant cumulative view impairment
since all of the homes along Corinna Drive are at significantly
lower elevations than the homes along Deluna Drive.
Section 6: That the redesigned project, as further
conditioned by the Planning Commission, satisfies the neighborhood
compatibility criteria since the balcony on the south elevation of
the addition (from the master bedroom) has been eliminated and the
windows along the west elevation of the addition (from the master
bedroom) will incorporate a translucent material in order to
prevent an invasion of privacy into the adjacent neighbor's rear
yard.
Section 7:. For the foregoing reasons and based on the
information and findings included in the Staff report, and records
of the proceedings, the Planning Commission hereby upholds the
appeal of Height Variation No. 773, thereby modifying the Acting
Director's decision and approving the project subject to the
conditions contained in Exhibit "All, attached hereto and made a
part hereof, which are necessary to preserve the public health,
safety, and general welfare in the area.

CONDITIONS OF APPROVAL
HEIGHT VARIATION NO. 773—APPEAL
(3348 CORINNA DRIVE)
1) The maximum height of the addition shall not exceed 221-61, or
a ridge elevation of 121.331 as measured from pad elevation
98.831 at the rear of the house.
2) The minimum required side yard setback shall be no less than
51-011.
3) A completed and notarized covenant to Protect Views shall be
submitted to the Environmental services Department upon
submittal of the approved set of plans into the Building &
Safety Division's Plan Check process.
4) The maximum eave projection allowed into the required setbacks
shall not exceed 411 for each 11-011 of required setback.
5) No grading has been granted with this approval.
6) At least 50% of the twenty foot (201-011) front yard setback
area shall be maintained as landscaping.
7) The additions shall be constructed to substantial conformance
to the approved set of plans. Any modifications to said plans
shall be reviewed by the Director of Environmental Services.
8) The balcony along the south elevation (from the master bedroom)
shall be eliminated (and is not to be constructed).
9) The two windows along the west elevation located in the master
bedroom shall incorporate translucent material such that light
will be allowed through windows but viewing from the windows
will not be possible.
10) The project shall be constructed in substantial conformance
with the revised plans submitted to the City and reviewed by
the Planning Commission on July 13, 1993.
