A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO.
68, REVISION B (TRACT NO. 40640), THEREBY APPROVING A
MAXIMUM LOT COVERAGE NOT TO EXCEED 25% OF THE AREA FROM
THE FRONT PROPERTY LINE TO THE TOP OF THE BLUFF AND
AMENDING CONDITION NO. 3.B OF P.C. RESOLUTION NO. 81-57
TO INCREASE THE MAXIMUM RIDGE HEIGHT TO TWELVE FEET (121-
011) OR AN ELEVATION OF 223.0' ABOVE THE HIGHEST POINT OF
EXISTING GRADE ON THE LOT TO BE COVERED BY THE STRUCTURE
ON LOT NO. 1, 11 MARGUERITE DRIVE.
WHEREAS, Mr. Kenneth Burrell, representing the Burrell Group,
has submitted a request for Tract No. 40640, Amendment No. 4 and
Conditional Use Permit No. 68, Revision B to increase the ridge
height on Lot No. 1, 11 Marguerite Drive, to the Development code's
maximum sixteen feet height limitation (el. 227.01) allowed on an
RS -1 zoned lot; and,
WHEREAS, after a notice was issued pursuant to the provisions
of the Rancho Palos Verdes Development Code, the City Council of
the City of Rancho Palos Verdes held a public hearing on April 6,
1993 and May 20, 1993 regarding the tract amendment request. On
June 1, 1993, the City Council adopted Resolution No. 93-47 which
established a maximum lot coverage requirement and increased the
maximum ridge height to twelve feet (or an elevation of 223.01) as
measured from the highest point of existing grade on the lot to be
covered by the structure) on Lot No. 1; and,
WHEREAS, on June 8, 1993, the Planning Commission considered
the related application for Conditional Use Permit No. 68, Revision
B to modify the conditions of approval for the Residential Planned
Development so that they are consistent with the action taken by
the City Council.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That the conditional use permit amendment request
is a result of circumstances which make the maximum ridge height
established on Lot No. I no longer appropriate, since the lot
configuration has been modified through a Lot Line Adjustment to
move the front property line towards Palos Verdes Drive West and,
due to the natural slope of the property, would only permit a two
foot high structure as measured at the new front setback line. The
Council determined that an overall increase to twelve feet (121-011)
or an elevation of 223.01, would not create significant view
impairment from surrounding properties. Additionally, the grading
quantities necessary to accommodate a multi-level home will be
decreased as a result of the increase to a twelve foot (12'_011)
ridge height.
Section 2: That, in determining the appropriate lot coverage
for the subject lot, the Planning Commission compared the subject
lot with other bluff top lots within the Lunada Pointe tract. It
is the Commission's finding that applying the RS -1 25% maximum lot
coverage standard to the area of the subject lot included from the
front property line to the top of the bluff will result in a
residence that will be comparable in size with the other bluff top
homes found within the subject tract.
Section 3: That the proposed amendment to Conditional Use
Permit No. 68 does not conflict with the findings that were made by
the Planning Commission, pursuant to Development Code Section
17.56.060, in approving this Residential Planned Development
through P.C. Resolution No. 81-57.

TRACT NO. 40640 -AMENDMENT NO. 4
(LOT 1, #11 MARGUERITE DRIVE)
1) The maximum ridge height of a residence on Lot No. 1, 11
Marguerite Drive, shall not exceed an elevation of 223.01, as
measured from the highest point of existing grade on the lot
to be doveted by the structure. The existing grade on Lot 1
shall be taken from the map prepared for Lot Line Adjustment
No. 41, dated as received by the City on October 8, 1991 and
kept in the address file for 11 Marguerite Drive.
2) Any subsequent requests to raise the new ridge height shall be
reviewed by the City Council through a Tract Amendment. The
property owners shall not receive approval for an increase in
the maximum ridge height through the submittal of a Height
Variation application.
3) Any future development of the subject property shall be
limited to a maximum lot coverage of 25% for that portion of
the lot located between the front property line and the top of
the bluff. Therefore, 75% of the area located between the
front property line and the top of the bluff shall be
maintained as open space area. "Open space area" shall be
identified as defined in Development Code Section 17.40.040.
4) All applicable conditions of approval from Resolution No. 81-
87 (Tentative Tract Map No. 40640) are still in force and are
incorporated into this approval by reference.
