P.C. RESOLUTION NO. 93-12
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 355 AND
GRADING NO. 1675 TO ALLOW 180 CUBIC YARDS OF GRADING
INTO AN EXTREME SLOPE TO ACCOMMODATE A NEW 605 SQ. FT.
SEMI -SUBTERRANEAN GARAGE/WORKSHOP AT 6264 OCEAN TERRACE
DRIVE.
WHEREAS, the applicants, Dr. and Mrs. M.S. Lewis have
requested a Variance and Grading permit to allow a 180 cu. yds. of
grading into an extreme slope to accommodate a new 605 sq. ft.
semi -subterranean garage/workshop; and
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, (CEQA), the proposed project has been
found to be categorically exempt (Class III); and
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Development Code, a duly noticed public hearing was
held on April 27, 1993, at which time all interested parties were
given an opportunity to be heard and present evidence:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
section is That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved, or
to the intended use of the property, which do not apply generally
to other property in the same zoning district in that, the location
where the garage has been proposed is the only available area
remaining on the lot to place such a structure. This project is
similar to other recently approved requests for grading in extreme
slopes where the grading only involves "excavation" and the
finished structure will not be readily visible from surrounding
properties.
section 2: That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, that of further improving the property, which right is
possessed by other property owners under like conditions in the
same zoning district due to the constraining physical elements of
the lot including the sloping topography and the configuration of
the existing house and motorcourt.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located, since the new garage will not be visible from the street
or from nearby properties.
Section 4: That the granting of such a Variance will not be
contrary to the objectives of the General Plan or the or the
policies and requirements of the Coastal Specific Plan since the
General Plan encourages development within the City that maintains
and enhances the visual qualities of existing neighborhoods without
creating adverse impacts to the surrounding area. The subject
property is not located within the Coastal Zone.
Section 5: That the proposed grading will not pose a threat
to the public health, safety and welfare since there will be no
impacts to nearby residents, and since the proposal will be
forwarded to the City's Building and Safety Division for structural
review.
Section 6: For the foregoing reasons and based on the
information and findings included in the Staff report, and records
of the proceedings, the Planning Commission hereby approves
Variance No. 355 and Grading No. 1675, subject to the conditions
contained in Exhibit "All attached hereto and made a part hereof,
which are necessary to preserve the public health, safety, and
general welfare in the area.
PASSED, APPROVED, AND ADOPTED this 27th day of April, 1993.

EXHIBIT "A"
CONDITIONS OF APPROVAL
FOR VARIANCE 355 & GRADING NO. 1675
(6264 OCEAN TERRACE DRIVE)
a) Minimum 20'-0" front yard setback shall be maintained.
b) The applicant shall adhere to the Development Code's
requirement that a minimum of 50% of the twenty foot (20'-011)
front yard setback area shall be maintained as landscaping.
c) Maximum quantity of grading shall not exceed 180 cubic yards
(cut).
