RESOLUTION NO. 93- 11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES FORWARDING TO THE CITY COUNCIL A RECOMMENDATION FOR DENIAL OF GENERAL PLAN AMENDMENT NO. 19 AND ZONE CHANGE NO. 20 AND TO TAKE NO ACTION ON THE NEGATIVE DECLARATION PREPARED FOR ENVIRONMENTAL ASSESSMENT NO. 647 ON A 28,200 SQUARE FOOT VACANT SITE LOCATED AT 29941 HAWTHORNE BOULEVARD. WHEREAS, on September 1, 1992, the City Council of the City of Rancho Palos Verdes approved a request to initiate an amendment to the City's General Plan to change the land use designation on the subject property from Commercial Office to Residential/6-12 units per acre; and WHEREAS, on October 15, 1992, the landowner submitted applications for General Plan Amendment No. 19 to change the land use designation from Commercial Office to Residential/6-12 units per acre and Zone Change No. 20 to change the zoning designation from Commercial Profession to Residential Multiple -Family with 12 units per acre (RM -12); and WHEREAS, pursuant to the requirements of the California Environmental Quality Act, an Initial Study and Draft Negative Declaration were prepared which identified direct impacts to Land Use resulting from the proposed General Plan Amendment and Zone Change. Although construction on the subject property will result in other impacts to the environment, it was determined that the proposed residential designation would result in future development of the property in a similar manner and intensity as would be expected under the existing Commercial designation. These future impacts of development, including biology, geology, air, noise, light and glare, population and housing, public services, and utilities were discussed in the Initial Study and Draft Negative Declaration, but were determined not to be significant with respect to the change in land use. This document was circulated to the public from January 14, 1993 to February 17, 1993; and WHEREAS, on February 9, 1993, the Planning Commission of the City of Rancho Palos Verdes held a public hearing to discuss the Initial Study and Draft Negative Declaration at which time all interested parties were given an opportunity to be heard and present evidence, and WHEREAS, based on information submitted during the public comment period, the Initial Study was revisgd to address impacts to Views that may occur as a result of the proposed General Plan Amendment and Zone Change. This revised document was circulated to the public from March 18, 1993 to April 13, 1993; and WHEREAS, the Planning Commission of the City of Rancho Palos Verdes held duly noticed public hearings on March 8, 1993 and April 13, 1993 at which times all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: In forwarding to the City council a recommendation for denial, the Planning Commission finds that the proposed General Plan Amendment and Zone Change are not in the public interest due to potential view impairment that may occur from Crest Road and Hawthorne Road which are identified as visual corridors in the City's General Plan. The Planning Commission also identified potential view impairment that may occur from private residences located in the Seagate Condominiums and other properties located on Ocean Crest Drive and Sattes Drive in the City of Rancho Palos Verdes and from Cresta Verde Drive in the City of Rolling Hills Estates. In addition, the Planning Commission felt that the uncertainty surrounding the geology on the site should be determined before the City takes action on a request to change the land use. Section 2: For the foregoing reasons and based on the information and findings contained in the Staff Report, minutes, and records of the proceedings, the Planning Commission hereby forwards to the City Council a recommendation for denial of General Plan Amendment No. 19 and Zone Change No. 20 to change the land use designation from Commercial Office to Residential/6-12 units per acre and to change the zoning designation from Commercial Professional to Residential Multiple -family with 12 units per acre and to take no action on the Negative Declaration prepared for Environmental Assessment No. 647 on property located at 29941 Hawthorne Boulevard.
