A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES UPHOLDING
THE APPEAL OF MINOR EXCEPTION PERMIT NO. 453
THEREBY APPROVING THREE "BOW" WINDOWS AND TWO
SUPPORT COLUMNS TO ENCROACH INTO THE FRONT YARD
SETBACK AT 4011 PALOS VERDES DRIVE SOUTH. •
WHEREAS, on August 12, 1992, Uday and Sandhya Patil applied
for Minor Exception Permit No. 453 to allow three "bow" windows and
two support columns to encroach a maximum of three feet into the
required twenty foot front yard setback; and
WHEREAS, on December 14, 1992, the Director of Environmental
Services approved the permit, subject to conditions of approval.
The landowner requested that the Director extend the 15 day appeal
period to January 4, 1993, since City Hall was closed over the
holidays. The Director granted the request for an extension and
the landowner filed an appeal on January 4, 1993 ; and
WHEREAS, after notice issued pursuant to the requirements of
the Development Code, the Planning Commission held a public hearing
on February 23, 1993, at which time all interested parties were
given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That, due to the constraints associated with the
existing floor plan of the residence, the landowner is unable to
add a reasonable amount of new square footage to the master bedroom
and living room without building out to the required twenty foot
front yard setback line.
Section 2: That the proposed minor encroachments into the
front yard setback will add articulation to the front facade of the
residence and will provide for architectural variety along the
streetscape.
Section 3 : That there are structural difficulties in
cantilevering the "bow" windows as required by Staff and that
allowing the windows to cantilever from the floor joints will
provide a safer design that can be adequately screened from view
along the public right-of-way.
Section 4: For the foregoing reasons and based on the
information and findings included in the Staff Report, minutes and
records of proceedings, the Planning Commission of the City of
Rancho Palos Verdes hereby upholds the appeal of Minor Exception
Permit No. 453, thereby approving the project, subject to the
conditions of approval in the attached Exhibit "A" which are
necessary to preserve and protect the public health safety and
welfare in the area.

Conditions of Approval
Minor Exception Permit No. 453 - Appeal
4011 Palos Verdes Drive South
1. A maximum 42 inch high planter shall be installed to screen
the base of the two "bow" windows on the upper pad level.
2 . The maximum encroachment of the three "bow" windows and the
two entry support columns shall be limited to 2 feet into the
required 20 foot front yard setback.
3 . Prior to the issuance of building permits, the landowner shall
submit to the Environmental Services Department a completed
and notorized Covenant to Maintain Property to Protect Views.
