A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 351 FOR A 41-611 REDUCTION IN THE REQUIRED
101 STREET SIDE SETBACK AT 28601 MT. ROSE.
WHEREAS, Anthony and Callista Dean have submitted Variance No.
351 to allow a maximum 41-611 foot encroachment into the required
street side yard setback; and
WHEREAS, after notice issued pursuant to the requirements of
the Development Code, a public hearing was held before the Planning
Commission of the City of Rancho Palos Verdes on January 26, 1993,
at which time all interested parties were given an opportunity to
be heard and present evidence; and
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: 'That there are exceptional or extraordinary
circumstances which apply to this property which do not apply
generally to other property in the same zoning district since the
lot is of a substandard size (5,545 square feet in a minimum 10,000
square foot lot district); and little area exists on this lot for
expansion.
Section 2: That the variance is necessary for the
preservation and enjoyment of the substantial property right of the
applicant, and that this right is possessed by other property
owners under like conditions in the same zoning district in that
other properties are able to make minor additions to their homes.
Section 3: That the granting of the variance will not be
materially detrimental to the public welfare or injurious to the
property and improvements in the area in which the property is
located because the addition will not impair views from the
adjacent surrounding properties, nor will it interfere with the
intersection visibility triangle.
Section 4: That the granting of the variance will not be
contrary to the objectives of the General Plan because the primary
use of the lot will remain single family residential.
- Section 5: For the foregoing reasons and based on the
information and findings included in the Staff Report and records
of proceedings, the Planning Commission of the City of Rancho Palos
Verdes hereby approves Variance No. 351, thereby approving the 95
square foot living room addition subject to the Conditions of
Approval listed in the attached Exhibit "A," which are necessary to
preserve the public health, safety, and general welfare in the
area.
PASSED, APPROVED AND ADOPTED this 26th day of January, 1993.

1. The street side setback shall be a minimum of 61- 611 and the
front setback shall be 20"- 011.
2. The maximum height of the addition shall not exceed 161- 011
measured from existing grade to the top of the new roof over
the bay window.
3. Maximum allowable eave projections shall not exceed 411 for
each 11- 011 of required setback.
4. The minimum open space to be maintained shall be 50% of the
lot.
5. The applicant shall install landscaping in the front setback
prior to issuance of final building permits.
