RESOLUTION NO. 93-2 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES FINDING THAT THE VACATION OF THE ROAD AND TRAIL EASEMENT IN TRACT NO. 46422 IS IN CONFORMANCE WITH THE POLICIES OF THE GENERAL PLAN AND RECOMMENDING THAT THE CITY COUNCIL VACATE SAID ROAD AND TRAIL EASEMENT. WHEREAS, on November 1, 1988, the City approved Tentative Tract Map No. 46422, which subdivided a 2.5 acre site into 7 single family residential lots; and WHEREAS, Condition No. 6 of Resolution No. 88-66 reduced the size of an existing 25 foot wide easement for road, public utility and bridle trail purposes located along the southern boundary of the site to 10 feet in width and included a provision to allow the developer or the homeowners to request full abandonment of the easement in the future; and WHEREAS, several property owners in the subdivision have requested that the City vacate the road and trail easement along the southern boundary of the tract; and WHEREAS., on November 17, 1992, the City Council adopted Resolution No. 92-109 declaring intent to vacate the easement along the southern boundary of the tract; and WHEREAS, the Planning Commission held a hearing on January 12, 1993 to determine whether the proposed easement vacation is in conformance with the policies of the General Plan. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the vacation of the easement is consistent with the policies of the General Plan which require that all new residential developments be served by adequate infrastructure, since all utility and road easements necessary to service the subdivision were obtained at the time the final map was recorded. Section 2: That the vacation of the easement is consistent with the policies of the General Plan which require that all new developments provide public walkway, bikeway and equestrian systems, were appropriate, since the trail maps in the General Plan and the Conceptual Trails Plan do not include any public trails through the subject tract and there is no new evidence to suggest that a public trail is necessary or appropriate in this area of the G�tX. Section 3: For the foregoing reasons and based on the information and findings included in the Staff Report and records of the proceedings, the Planning Commission hereby finds that the vacation of the road and trail easement along the southern boundary of Tract No. 46422 is in conformance with the policies of the General Plan and recommends that the City Council vacate said road and trail easement.
