A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 348 ALLOWING A TEN FOOT REDUCTION TO THE
FIFTEEN FOOT MINIMUM REAR YARD SETBACK AT
31205 GANADO DRIVE.
WHEREAS, the applicants, Robert and Marilee Smith, have
requested a Variance to add a family room and covered patio in
their rear yard which will encroach 101011 into the rear yard
setback, at their existing home at 31205 Ganado Drive; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Pal,,,Verdes Development Code, a public hearing was
held on December8, 1992, at which time all interested parties
were given an opportunity to be heard and present evidence:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, in that the lot is substandard in size, and the only
possible area for a significant single story addition is at the
proposed location.
Section 2: That such a Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicants, and said right is enjoyed by other property owners
under like conditions. Due to the configuration of the lot, there
is no other reasonable alternative for the requested additions.
The right to build an addition of this size onto a comparably -
sized existing structure zone is a right possessed by other
property owners under like conditions in the same zoning district.
Section 3: That granting the Variance will not be materially
detrimental to the public welfare or injurious to property and
improvements in the area in which the project is located since the
addition will not be highly visible from the public right-of-way
and will not adversely affect the architectural style and
integrity of the existing residence.

Section 4: That the granting of such a Variance will not be
contrary to the objectives of the General Plan nor the goals and
policies of the Coastal Specific Plan since the residential use of
the property will not be altered as a result of the additions and
the property is not located within the Coastal Zone.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff Report and records
of the proceedings, the Planning Commission hereby approves
Variance No. 348 subject to the conditions contained in Exhibit
"All attached hereto and made a part hereof, which are necessary to
preserve the public health, safety, and general welfare in the
area.

Front: 371-011 (no changes)
Sides: 181-011 north
121-011 south
Rear: 50-011
2. The maximum ridgeline height of the new additions shall not
exceed 161-011.
3. Eavelines may project a maximum 411 into each required foot of
setback. (Maximum 2011 in rear; 4811 along west side)
4. The applicant shall either submit a landscape covenant to the
Director of Environmental Services prior to the issuance of
building permits, or shall arrange for a Site Vegetation
Inspection and comply with any requirement to trim foliage on
the subject property.
