PC RES 1992-073 P.C. RESOLUTION NO. 92-73 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 344 TO ALLOW AN EIGHT FOOT - SIX INCH (8'-6") MAXIMUM ENCROACHMENT INTO THE REQUIRED TWENTY FOOT (20'-0") FRONT YARD SETBACK AT 7012 CALLE del PAJARITO. WHEREAS, the applicants, Mr. and Mrs. Robert Williams have requested and obtained administrative approval for Height Variation No. 758, which is contingent upon the granting of Variance No. 344; and WHEREAS, the applicants have requested a Variance to allow an eight foot - six inch (8'-6") encroachment into the required twenty foot (20'-0") front yard setback to accommodate a 376 sq. ft. second story addition at the front of the residence; and WHEREAS, after notice pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on November 24, 1992, at which time all interested parties were given an opportunity to be heard and present evidence: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning district in that the subject lot is both substandard in size and irregularly shaped. The 9, 100 sq. ft. subject lot is 4,000 sq. ft. smaller than a newly created RS-3 zoned lot. Along with the smaller lot size, the applicant is further restricted from improving the lot because of the 2 .5: 1 transitional slope on the eastern side of the property that makes up 15% of the lot. Since the subject lot is situated at the end of a cul-de-sac, the front property line runs parallel with the curved "bulb" of the cul-de-sac, which compounds the difficulty of improving the property. Section 2: That such a Variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, that of further developing the property, which right is possessed by other property owners under like conditions in the same zoning district since, without the Variance, improvements are limited due to the constraining physical elements of the lot as mentioned above. Other homes in the area also seem to encroach into the front yard setback and thus the right is possessed by other residents in the area. Section 3: That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located since as analyzed under the Height Variation review, the second story addition which encroaches into the front yard setback will not cause view impairment or any other type of adverse impact. Section 4: That the granting of such a Variance will not be contrary to the objectives of the General Plan or the or the policies and requirements of the Coastal Specific Plan since the General Plan encourages development within the City that maintains and enhances the visual qualities of existing neighborhoods without creating adverse impacts to the surrounding area. It is Staff's opinion that the proposed project will accomplish this objective. The subject property is not located within the Coastal Zone. Section 5: For the foregoing reasons and based on the information and findings included in the Staff report, and records of the proceedings, the Planning Commission hereby approves Variance No. 344 subject to the conditions contained in Exhibit "A" attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. Resolution No. 92- 73 Page 2 EXHIBIT "A" CONDITIONS OF APPROVAL FOR VARIANCE NO. 344 (7021 Calle del Pajarito) a) Maximum allowed front yard setback encroachment shall not exceed eight feet-six inches (8'-6") at the northeast corner of the addition. b) Minimum five foot (5'-O") side yard setback shall be maintained. c) All of the conditions of approval from H.V.
