A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 339 TO ALLOW
A 936 SQUARE FOOT FIRST AND SECOND STORY ADDITION TO BE
CONSTRUCTED IN AN EXTREME SLOPE AT 7004 CLOVERCLIFF
DRIVE.
WHEREAS, Mr. and Mrs. James Hsu have requested approval for a
variance to allow a 936 square foot addition to be constructed in
the extreme slope at the front of the property on Clovercliff Drive
and;
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearing was held on
November 10, 1992, at which time all interested parties were given
an opportunity to be heard and present evidence:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do not
apply generally to other properties in the same zoning district, in
that the location of the extreme slope through the middle of the
lot diminishes the quantity of level building surface.
Section 2: That such a variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant's and said right is enjoyed by other property owners
under like conditions in the same zoning district since the
irregular topography of the property limits the ability of the home
owner to improve his property to the extent that others are able to
in this tract.
Section 3: That the granting of the variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area where the property is located
since the location of the proposed addition, in the front of the
property would not affect the views from adjacent residences, will
maintain an adequate setback from the front property line and that
proof of the use of adequate construction materials will be
required prior to building approval.
Section 4: That the granting of the variance will not be
contrary to the objectives of the General Plan or the policies of
the Coastal Specific Plan since the General Plan standards of
housing quality and design are maintained. The proposed addition
would be an improvement to the overall character of the
neighborhood and allow the applicant to further enjoy the use of
their property. The property is not located in the Coastal
District.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff Report and records
of the proceedings, the Planning Commission hereby approves
Variance No. 339, subject to the conditions of approval in Exhibit
"All which are necessary to preserve and protect the public health,
safety and welfare.

Variance No. 339
1. The applicant shall obtain all necessary Building Permits from
the City's Building and Safety Division.
2. Maximum height of the addition shall not exceed 16 feet in
height from the highest point covered by the
structure, (elevation 115. 0) , and shall not exceed an elevation
of 131.0. CRITICAL, RIDGE HEIGHT CERTIFICATION REQUIRED.
3. Planning approval is for the 936 square foot first and second
story addition only.
4. The applicant shall plaster, stucco, or resurface the subject
addition in a color to match the main structure.
5. The amount of grading shall be limited to a total of 19 cubic
yards cut and fill and the proposed retaining wall height
shall not be in excess of 5 feet.
6. All disturbance to the adjacent slope shall be minimized
during construction and restored by soil compaction and
revegetation.
7. All of the required setbacks shall be maintained: 5 feet in
the side yard, 20 feet in the front yard and 15 feet in the
rear yard.
