A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DENYING CONDITIONAL USE PERMIT NO.
166, VARIANCE NO. 307, GRADING PERMIT NO. 1585 AND
ENVIRONMENTAL ASSESSMENT NO. 627 FOR CONSTRUCTION OF A
NEW FULL SERVICE CAR WASH, SMOG INSPECTION FACILITY, AND
OIL CHANGE FACILITY ON PROPERTY LOCATED AT 28798 SOUTH
WESTERN AVENUE.
WHEREAS, on August 29, 1992, the applicant submitted
applications for construction of a new full service car wash and
smog inspection facility which were deemed complete for processing
on September 20, 1991; and
WHEREAS, after subsequent review of the applications and
Environmental Assessment questionnaire, it was determined that
additional noise and traffic analyses were required prior to
further processing of the applications; and
WHEREAS, additional noise and traffic analyses were submitted
which indicated potential adverse environmental impacts associated
with the project. Based on this information, the City prepared an
Initial Study and Draft Mitigated Negative Declaration which was
circulated and available for public review for a period of 21 days;
and
WHEREAS, after notice issued pursuant to the City's
Development Code, the Planning Commission of the City of Rancho
Palos Verdes held public hearings on August 25 and October 27, 1992
at which time all interested parties were given the opportunity to
be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That, in denying the Conditional Use Permit,
the Planning Commission finds:
A. The site for the intended use is not adequate in size and
shape to accommodate the proposed use in that the
placement of the necessary structures and facilities
within the required setback areas and along the rear and
side property lines would be required to accommodate the
use.
B. Although the site is located on Western Avenue which is
a highway designed to carry the type and traffic
generated by the proposed use, access to the site will
conflict with other adjacent institutional uses and may
create traffic conditions, such as a backup of vehicles
from the queuing area onto Western Avenue, which are
hazardous to the public health, safety, and welfare.
C. If this use were approved at this specific location, the
proposed project would result in significant adverse
effects relating to noise on the adjacent residential
properties located to the north and east of the project
site as well as adverse effects relating to noise and
traffic on the adjacent institutional property located to
the south of the project site.
D. That implementation of certain mitigation measures,
including, but not limited, to construction of a 12 foot
high sound wall and elimination of the blower and dryer
units for the car wash, will not reduce the adverse
impacts associated with this use to less than significant
levels. These impacts, in addition to impacts associated
with traffic, would not conform with the intent and
purposes set forth in the Code for the protection of the
public health, safety, and welfare.
Section 2: That, in denying the Variance, the Planning
Commission finds:
A. There are no exceptional or extraordinary circumstances
or conditions applicable to the property involved because
the property may still be used for another commercial use
which is allowed in the Commercial General (CG) zoning
district.
B. That approval of this variance would be materially
detrimental to the public welfare or injurious to
property and improvements in the area because, if
approved, structures and sound walls would be built along
the property line, with no setback or buffer area
provided to separate the proposed use from adjacent
residential and institutional properties.
Section 3: For the foregoing reasons and based on
information and findings contained in the Staff Report, Minutes,
and records of the proceedings, the Planning Commission of the City
of Rancho Palos Verdes hereby denies Conditional Use Permit No.
166, Variance No. 307, Grading Permit No. 1585, and Environmental
Assessment No. 627 for a new full service car wash, smog
inspection, and oil change facility at 28798 S. Western Avenue.
