PC RES 1992-0620 P.C. RESOLUTION NO. 92-62 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 165 -REVISION "A" AND GRADING NO. 1662, TO ALLOW EXPANSION OF THE EXISTING FACILITIES AND CONSTRUCTION OF A TWO STORY BUILDING 28 FEET IN HEIGHT AT 5300 CREST ROAD (DAUGHTERS OF MARY AND JOSEPH). WHEREAS, the Daughters of to Conditional Use Permit requesting to expand the two story facility to be Novitiate Building with a square foot addition to facility; and Mary and Joseph has submitted a revision No. 165 and Grading Application No. 1662 existing facilities and construct a new added to the existing 12,531 square foot total square footage of 10,025 and a 600 an existing 4,500 square foot classroom WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on October 13, 1992 at which time all interested parties were given an opportunity to be heard and present evidence; and NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: After review of the scope and merit of the project it is the City's determination that the project has no potential for causing a significant effect on the environment; and Section 2: That the proposed development will occur in the southwest corner of the parcel and all proposed structures would meet the front, side and rear setbacks requirements and the maximum height is less than that permitted in the Institutional zoning district under a Conditional Use Permit, therefore, the 5.98 acre site is adequate in size and shape to accommodate the proposed use. Section 3: That the site for the proposed use is adequately served by Crest Road which continues along the front of the subject property and is a fully developed roadway identified in the General Plan as a major arterial roadway for ingress and egress purposes which is properly designed to carry the type and quantity of traffic generated by the project. Section 4: That the proposed Marian Center would function as housing for the senior members of the Daughters of Mary and Joseph and would constitute the use of one additional vehicle for transportation purposes and would not have a significant effect to existing parking which currently serves the facility with 94 spaces. 0 Section 5: That construction at the subject property will not constitute a significant adverse impact to adjacent property by view impairment or excessive noise. Section 6: That the property, which is zoned for institutional purposes and is identified in the General Plan as an institutional use for religious purposes, will continue to be used as a Retreat Center/Convent and is therefore, not contrary to the goals and policies of the General Plan. Section 7: That 300 cubic yards of grading has been the only grading request in the history of the property and is considered a small quantity which is not excessive beyond that necessary for the primary use of the lot. Section 8: That grading will not significantly adversely affect the visual relationships with, nor the views from neighboring sites because the proposed retaining wall will not be visible from the adjacent properties or the public right-of-way. Section 9: That because the grading will occur in areas previously disturbed during construction of the existing facilities and not within the extreme slope areas on the property, the nature of the grading minimizes the disturbance to the natural contours. Section 10: For the foregoing reasons and based on the information and findings included in the Staff Report and records of the proceedings, the Planning Commission hereby approves Conditional Use Permit No. 165 -Revision "All and Grading No. 1662 to allow expansion of the existing facilities and the construction of a retaining wall not to exceed three feet in height around the southern and western sides of the proposed facility, subject to the Conditions of Approval in the attached Exhibit "All which are necessary to protect the public health, safety and welfare. Resolution No. 92-62 Page 2 0 EXHIBIT A FJ CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT NO 165 -REVISION "All GRADING PERMIT NO. 1662 1. Within 30 days of this approval the applicant and the landowner shall submit, in writing a statement that they have read and understand all conditions of approval contained in this exhibit. Failure to provide such a statement shall render this approval null and void. 2. Prior to issuance of building permits the landowner shall submit an exterior lighting plan for review and approval by the Director of Environmental services. All lighting shall be directed downwards and shielded to prevent illumination of other properties. All lighting shall conform to section 17.54.030 of the Development Code. Minor modifications to the lighting plan shall be subject to the review and approval of the Department of Environmental Services. 3. The maximum height of the proposed Marian Center shall not exceed 28 feet, maximum ridge elevation shall not exceed 128.45, with ridge height certification required. Height shall be measured from the elevation of 100.45. To be measured from existing adjacent grade. 4. The maximum height of retaining walls shall not exceed 3 feet measured from the adjacent grade at the front of the wall. A guard rail which meets the Building Code requirements shall be installed at the top of the retaining wall. The total combined height of the wall and guard rail shall not exceed six feet. No other retaining walls are proposed or approved. Other freestanding walls allowable within the Code may be permitted and shall be limited to a height of 6 feet. 5. Prior to building permit issuance the property owner shall gain permission to construct this facility from all utility easement owners within the area of the proposed addition. All overhead utility lines in this area shall be removed, and rerouted either underground or another acceptable location subject to the approval of the owner of said easement and the Division of Environmental Services. 6. Prior to building Permit issuance this application shall be reviewed by the County Fire Department. for compliance with Fire Code Regulations. 7.
