A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
CONDITIONAL USE PERMIT NO. 172 TO LEGALIZE
THE EXISTING USE AND ALLOW AN EXPANSION OF
THE FACILITY AND DENYING VARIANCE NO. 340
TO ALLOW A 4, 000 SQ. FT. STORAGE SHED TO BE
LOCATED ALONG THE WESTERN PROPERTY LINE AT
5837 CREST ROAD.
WHEREAS, the applicant, the California Water Service Company,
has requested a Conditional Use Permit to legalize the existing use
of the site and allow an 1,800 sq. ft. office/storage addition and
a Variance for a 4, 000 sq. ft. storage shed along the westerly
property line; and
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearing was held on
September 22, 1992, at which time all interested parties were given
an opportunity to be heard and present evidence:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the site for the intended use is adequate in
size and shape to accommodate said use and for a l l of the yards,
setbacks, walls or fences, landscaping and other features required
by this title or by conditions imposed under this section to adjust
said use with those on abutting land and within the neighborhood in
that the site is five acres in area and can accommodate both the
existing facility and the proposed office expansion and storage
shed. The existing and proposed structures will cover only 5% of
the lot.
Section 2: That the site for the proposed use relatesto
streets and highways properly designed to carry the type and
quantity of traffic generated by the subject use since
the proposed additions to the existing facility will not have
any impact on the amount of traffic generated by the utility
company. Again, the addition will serve to accommodate staff
and storage material that has outgrown the existing building's
capacity.
Section 3: That, in approving the subject use at the specific
location, there might be a significant adverse effect on adjacent
property or the permitted use thereof therefore the Commission
required that the storage shed be moved five feet (5'-O") from the
property line and that landscaping be provided between the storage
shed and the existing chain link fence to serve as additional
screening. It is the Commission's opinion that the office addition
will not be seen at all from any of the units on the adjacent
property. There will be no significant impacts to the properties

north of the subject site due to the separation (Scottwood Drive)
and significant distance between the properties. The densely
vegetated eastern side of the subject property will act as a buffer
between the single family residences and the applicant's lot.
Section 4: That the proposed use is not contrary to the
General Plan since the General Plan promotes improvements to the
City's infrastructure and the ability to provide adequate public
utilities throughout the City that maintain or improve the
quality and standards of existing neighborhoods without creating
adverse impacts to the surrounding area. It is the Commission's
opinion that the project, as modified, will not create an adverse
impact to the area.
Section 5: That there are no exceptional or extraordinary
circumstances or conditions applicable to the property involved, or
to the intended use of the property, which do not apply generally
to other property in the same zoning district since the property is
five (5) acres in area, with alternative areas to place the storage
shed structure.
Section 6: That such Variance is not necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions in the same zoning district since there is
sufficient area on the subject lot to allow the improvements
without the necessity of the Variance. By requiring the storage
shed to be located at least five feet (5 '-0") from the property
line and limiting the overall height of the structure to sixteen
feet (16 '-0") , the Commission is not removing the "property
improvement" right that is enjoyed by the applicant and other
property owners throughout the City.
Section 7: For the foregoing reasons and based on the
information and findings included in the Staff report, and records
of the proceedings, the Planning Commission hereby approves
Conditional Use Permit No. 172 subject to the conditions contained
in Exhibit "A" attached hereto and made a part hereof, which are
necessary to preserve the public health, safety, and general
welfare in the area and denies Variance No. 340.

CONDITIONS OF APPROVAL FOR
CONDITIONAL USE PERMIT NO. 172

a. Within thirty (30) days of this approval, the applicant
shall submit, in writing, a statement that he has read and
understands all conditions of approval. Failure to provide
such a statement shall render this approval null and void.
b. The applicant shall obtain approval from the Director of
Environmental Services prior to making any modifications or
additions to the site (including lighting, addition of any
structures, etc. ) .
c. All conditions shall be complied with and maintained in a
good faith effort from the applicant. This approval may be
revoked by the Director of Environmental Services if any of
these conditions of approval are not complied with.
d. The life of the Conditional Use Permit shall run with the
current use of the property.
e. Maximum height of the office/storage addition shall not
exceed 10 '-3" (or an elevation of 1200.25 ' as measured from
the northeast corner of the addition) .
g. Maximum height of the storage shed shall not exceed 16 '-0"
(or an elevation of 1202 . 6 ' as measured from the southwest
corner of the structure) .
h. The storage shed shall be located at least five feet (5 '-0")
from the westerly property line.
i. The applicant shall landscape the area between the storage
shed and the existing chain link fence. A Landscape Plan
shall be submitted for review and approval by the Director of
Environmental Services. The intent of this condition is to
screen only those areas that may not be screened by the
existing vegetation on the transitional slope.

j . The existing fence along the west property line adjacent to
the storage structure shall be maintained or replaced in kind
if it must be removed during construction.
k. The west wall of the shed shall be constructed of
decorative/split face block material to be reviewed and
approved by the Director of Environmental Services.
