A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES UPHOLDING
HEIGHT VARIATION NO. 741-APPEAL, THEREBY
APPROVING THE REQUEST FOR AN 800 SQUARE
FOOT SECOND STORY ADDITION THAT WILL
MEASURE 21'-6" IN HEIGHT AT 28220 GOLDEN
MEADOW DRIVE.
WHEREAS, the applicant, Mr. Howard Dielmann, had requested a
Height Variation to allow a 894 sq. ft. second story addition which
• would measure 21'-0", and a Variance to allow a 6 '-6" encroachment
of the structure into the front yard setback; and
WHEREAS, after careful consideration of the Height Variation
request, the Acting Director of Environmental Services denied the
project based on the finding that it would create both significant
and cumulative view impairment and would not maintain the
compatibility of the neighborhood; and
WHEREAS, within fifteen days after the Acting Director's
decision, the applicant filed an appeal; and
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearing was held on May 26
1992, at which time all interested parties were given an
opportunity to be heard and present evidence relative to the Height
Variation appeal and the Variance request;
WHEREAS, it was the Commission's opinion that the project
would not create significant or cumulative view impairment and
would not maintain the compatibility of the neighborhood and
directed the applicant to redesign the project to move the mass of
the second story addition to the main portion of the residence so
as not to necessitate the Variance; and
WHEREAS, on June 23, 1992, the Planning Commission reviewed
the applicant's modified proposal and made the determination that
the new project still did not satisfy the neighborhood
compatibility and gave further direction to the applicant to
redesign the structure; and
WHEREAS, on September 8, 1992 , the Planning Commission
considered the applicant's newly revised proposal; and
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the revised project does not create
significant view impairment from any surrounding properties since
the addition has been relocated further back onto the main portion
of the house.
Section 2: That the revised project does not create
significant cumulative view impairment and that any future requests
for second story additions to homes in the area will be evaluated
on a case by case basis to decide on the merits of each individual
request.
Section 3: That the revised project as it has been
redesigned satisfies the neighborhood compatibility criteria since
the addition has been relocated onto the main portion of the
structure and several architectural features have been incorporated
into the design to create a more aesthetically pleasing, compatible
structure.
Section 4: For the foregoing reasons and based on the
information and findings included in the Staff report, and records
of the proceedings, the Planning Commission hereby approves the
appeal of Height Variation No. 741, thereby overturning the Acting
Director's decision and approving the project subject to the
conditions contained in Exhibit "A", attached hereto and made a
part hereof, which are necessary to preserve the public health,
safety, and general welfare in the area.
PASSED, APPROVED, AND ADOPTED this 22nd day of September, 1992 .

EXHIBIT "A"
CONDITIONS OF APPROVAL FOR
HEIGHT VARIATION NO. 741-APPEAL (28220 GOLDEN MEADOW)
a) Maximum height of the structure shall not exceed 21'-6"
as measured from existing grade at the northwest corner of the
structure.
b) Minimum 5 '-0" side yard setback shall be maintained.
c) The front of the second story addition shall be located
at least 35'-5" from the front property line.
d) The applicant shall either submit a completed and notarized
Covenant to Protect Views ("Landscape Covenant") to the
Environmental Services Department at the time of
submittal of plans into the Building & Safety
Division's plan check process or request that a view analysis
be performed by Staff to determine any view impairment
resulting from existing foliage.
e) Maximum eave projections into required setbacks shall
not exceed four inches (4") for each required one foot
(1'-0") of required setback.
f) The plans dated August 3, 1992 shall be considered the
approved set of plans.
