PC RES 1992-056• PC RESOLUTION NO 92- 56 0 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO 343 TO ALLOW A 136 SQUARE FOOT ADDITION TO EXTEND A MAXIMUM OF 2 FEET OVER THE EXTREME SLOPE ON THE WEST SIDE OF THE PROPERTY AT OCEAN TERRACE DRIVE. WHEREAS, Warren Sterling and Barbara Marbell have requested approval for a variance to allow a 136 square foot addition to extend a maximum of 2 feet over the extreme slope on the west side of the property and; WHEREAS, after notice pursuant to the provisions of the Rancho Palos Verdes Development Code a public hearing was held on September 8, 1992 at which time all interested parties were given an opportunity to be heard and present evidence: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that the applicant's lot is triangular in shape and presents a topographic disadvantage due to the sloping nature of the west side of the lot adjacent to Highridge Road. Section 2: That such a variance is necessary for the preservation and enjoyment of a substantial property right of the applicant's and said right is enjoyed by other property owners under like conditions in the same zoning district since the irregular shape of the property limits the ability of the home owner to improve his property to the extent that others are able to in this tract. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area where the property is located since the location of the proposed addition, adjacent to Highridge Road, would not affect the views from adjacent residences, will maintain an adequate setback from Highridge Road and that proof of the use of adequate construction materials will be required prior to building approval. Section 4: That the granting of the variance will not be contrary to the objectives of the General Plan or the policies of the Coastal Specific Plan since the General Plan standards of housing quality and design are maintained. The proposed addition would be an improvement to the overall character of the neighborhood and allow the applicant to further enjoy the use of their property. The property is not located in the Coastal District. • Section 5: For the foregoing reasons and based on the information and findings included in the Staff Report and records of the proceedings, the Planning Commission hereby approves Variance No. 343, subject to the conditions of approval in Exhibit "All which are necessary to preserve and protect the public health, safety and welfare. Resolution No. 92- 56 Page 2 L71 EXHIBIT "A" Conditions of Approval Variance No.'343 i 1. The applicant shall obtain all necessary Building Permits from the City's Building and Safety Division. 2. Maximum height of the addition shall not exceed 16 feet in height. 3. The addition shall not encroach further than 2 feet into the extreme slope area along the western side of the property. 4. Planning approval is for the 136 square foot addition only. 5. The applicant shall plaster, stucco, or resurface the subject addition in a color to match the main structure. 6. No grading is approved as a part of this permit. Separate grading permit grading application shall be required for any grading in excess of 20 cubic yards and/or cut in excess o 3 feet cut or fill. 7. All disturbance to the adjacent slope shall be minimized during construction and restored by soil compaction and revegetation. P. C. Resolution No. 92-56 Page 3
