RESOLUTION NO. 92-49 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 312 AND GRADING NO. 1579, ALLOWING A FIVE FOOT REDUCTION IN THE FRONT YARD SETBACK AND MINOR GRADING INTO AN EXTREME SLOPE AT 1433 CADDINGTON DRIVE. WHEREAS, the applicants, Patricia and Carmine Coppa, have requested a Grading Permit and Variance to construct a first and second story addition which would require minor grading into an extreme slope in the sideyard, and a five-foot encroachment into the front yard setback at 1433 Caddington Drive; and WHEREAS, after notice pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on July 28, 1992, at which time all interested parties were given an opportunity to be heard and present evidence: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that this 8400 square foot lot is smaller than the 10,000 square feet required for new lots in its zone, and there is no other logical alternative location for the addition. Section 2: That such a Variance is necessary for the preservation and enjoyment of a substantial property right of the applicants, and said right is enjoyed by other property owners under like conditions. The applicants' right to develop their property is limited due to the small size of their lot. other properties in the same zoning district with a larger lot would have an opportunity to expand their footprint in order to accommodate an addition of this size. Section 3: That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located since building standards for the proposed project will be reviewed and require approval from the City's Building and Safety Division. Resolution No. 92-49 Page 1 Section 4: That the granting of such a Variance will not be contrary to the objectives of the General Plan nor the goals and policies of the Coastal Specific Plan since the residential use of the property will not be altered as a result of the additions and the property is not located within the Coastal Zone. Section 5: For the foregoing reasons and based on the information and findings included in the Staff Report and records of the proceedings, the Planning commission hereby approves Variance No. 312 and Grading Permit No. 1579 subject to the conditions contained in Exhibit "All attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. All conditions of approval for Height Variation No. 724 granted on May 12, 1992 shall remain in effect. 2. Minimum front yard setback to accommodate the garage expansion shall be 15'-0" (5'-0" maximum encroachment). 3. Minimum sideyard setback shall be 6'-011. 4. Eaves may project a maximum 4" into setback for each 1'-0" of required setback. 5. Any necessary geologic assessments and/or reports shall be reviewed and approved by the City Geologist prior to the issuance of grading and/or building permits for that portion of the structure that encroaches into the extreme slope.
