Resolution No. 92-45 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES UPHOLDING THE APPEAL, THEREBY APPROVING THE PROPOSED FIRST AND SECOND STORY ADDITION AT 5724 SCOTWOOD DRIVE. WHEREAS, on November 15, 1991, the applicant, Dr. Mahesh Sejpal, submitted Height Variation No. 737 to allow a first and second story addition at 5724 Scotwood; and WHEREAS, on April 16, 1992, the Acting Director of Environmental Services denied Height Variation No. 737 for a second story addition with a maximum height of 26 feet; and WHEREAS, on May 1st, 1992, the Acting Director's decision was appealed by Dr. Mahesh Sejpal within the 15 day appeal period; and WHEREAS, after notice pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on June 9, 1992, and a continued hearing was held on July 14, 1992 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the applicant has complied with the early neighbor consultation process established by the City by submitting an early neighborhood consultation form with signatures of 70 percent of the residence within a 100 foot radius and 25 percent of the residents within a 100 foot radius. Section 2: That the proposed structure would not significantly impair a view from a public property, (parks, major thoroughfares, bikeways, walkways, equestrian trails) which has been identified in the City's General Plan or a City designated viewing area. Section 3: That the structure is not located on a proposed ridge or promontory. Section 4: That the structure is designed and situated in such a manner as to minimize impairment of a view in that the structure would be located at a lower elevation than the properties from which a view impairment would be expected. Section 5: That there is no significant view impairment caused by granting the height variation since the applicant's residence and other adjoining residences are situated on pads at varying elevations below the view from upslope properties from which the view impairment would be expected. 0 1 Section 6: That the proposed structure, when considered exclusive of existing foliage, does not significantly impair a view from the viewing area of another parcel, located in a portion of a structure which was constructed without a height variation or variance, or which would not have required a height variation or variance when originally constructed had this section, as approved by voters on November 7, 1989, been in effect at the time the structure was constructed. Section 7: That there is no significant cumulative view impairment that would result by granting this application. Section 8: That the proposed structure, as presented to, and modified by the Planning commission is compatible with the immediate neighborhood character in that the articulation and placement of the second story reduces the apparent bulk and mass of the structure. The 'addition utilizes architectural styles and materials predominant in the neighborhood and respects all setbacks and open space requirements. Section 9: For the foregoing reasons and based on the information and findings included in the staff report, minutes and records of the proceedings, the Planning commission hereby upholds the appeal of this project, thereby approving the proposed addition subject to conditions contained in the attached Exhibit "A", which are necessary to protect the public health safety and welfare. Resolution No. 92-45 Page 2 EXHIBIT "A" CONDITIONS OF APPROVAL HEIGHT VARIATION NO. 730 5724 SCOTWOOD 1. The following setbacks shall be maintained for the upper and lower level addition: 20 feet in the front yard, 5 feet in the side yard, and 15 feet in the rear yard. 2. Maximum eave projection shall not exceed 4" for every 110" of required setback distance. 3. No grading is permitted as a part of this approval. 4. Maximum height of the entry atrium shall not exceed 23.0 feet or 127.4 measured from grade adjacent to the south east elevation, (104.4). CRITICAL, RIDGE HEIGHT CERTIFICATION REQUIRED) 5. Maximum height of the west wing shall be limited to 26 feet or (130.4), to be measured from grade adjacent to the south east elevation (104.4) to the ridge. (CRITICAL, RIDGE HEIGHT CERTIFICATION REQUIRED) 6. A covenant to protect views, (Landscape Covenant), shall be submitted to the Department of Environmental Services prior to the issuance of building permits. 7. All windows at the south elevation of the second floor shall be opaque in order to maintain privacy of the residence on the west side of the subject property and shall be subject to the review and approval of the Director of Environmental Services. 8. The western elevation shall be adequately landscaped to the satisfaction of the Director of Environmental Services in order to cover the second story projection on the west side of the dwelling. 9. All skylights proposed for the second story shall not project more than 6 inches above the adjacent roof of the dwelling and shall not exceed the maximum ridge line of the proposed structure. 10. Minimum open space shall be maintained at 50 percent. 11. The approved project shall substantially conform to the plans reviewed and approved by the Planning Commission titled: "Sejpal Residence," and dated 6/15/92. P.C. Resolution No. 92-45 Page 3
