RESOLUTION NO. 92-42 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 330 AND GRADING PERMIT NO. 1628 FOR A 416 SQUARE FOOT DECK TO BE BUILT INTO AN EXTREME SLOPE ALONG THE EASTERN SIDEYARD OF AN EXISTING RESIDENCE AT 3655 HIGHTIDE DRIVE. WHEREAS, the applicants, Mr. and Mrs. Joe and Kim Spirito, have requested a Variance and Grading Permit to construct a 416 square foot deck into an extreme slope along the eastern sideyard of their existing residence at 3655 Hightide Drive; and WHEREAS, after notice pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on June 23, 1992, at which time all interested parties were given an opportunity to be heard and present evidence: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that the average slope of the applicants' lot is 75%, with no level, buildable areas existing for expansion other than within an extreme slope area, thereby requiring a Variance. The applicants do not have any alternative locations on the property for the addition of the deck to the existing residence other than where it has been proposed. Section 2: That such a Variance is necessary for the preservation and enjoyment of a substantial property right of the applicants, and said right is enjoyed by other property owners under like conditions. The applicants' right to develop their property is limited due to the steeply sloping nature of their lot. other properties in the same zoning district have an opportunity to construct a deck in their rear yard to expand their useable outdoor area. Section 3: That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located since the geology for the proposed project shall be reviewed and approved by the City's Geologist. • 0 Section 4: That the granting of such a Variance,will not be contrary to the objectives of the General Plan nor the goals and policies of the Coastal Specific Plan since the residential use of the property will not be altered as a result of the additions and the property is not located within the Coastal Zone. Section 5: For the foregoing reasons and based on the information and findings included in the Staff Report and records of the proceedings, the Planning Commission hereby approves Variance No. 330 and Grading Permit No. 1628 subject to the conditions contained in Exhibit "All attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. Materials for the deck shall be those represented in the submitted plans dated January 20, 1992, i.e., stucco walls, wood flooring, and plexiglass railing. 2. The proportions of the deck shall conform to the proposed plan (width: 30 feet; length: varying from 171611 where it meets the existing structure, to 101011 at the easternmost point). 3. Minimum setbacks: Front-10'0"/Side: 51011 4. A landscape plan shall be submitted to and approved by the Director of Environmental Services which provides appropriate screening of the deck as seen from the street below, prior to the issuance of building permits. 5. Maximum allowable grading: 33.3 cubic yards Maximum depth of allowable cut: 6 feet from grade (footings not included) 6. The property owner shall complete, notarize, and submit a Covenant to Protect Views to the Environmental Services Department prior to the issuance of building permits. 7 Geology reports shall meet required standards and shall be submitted for review and approval to the Building and Safety Department prior to the issuance of building permits.
