A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES DENYING THE APPEAL
OF HEIGHT VARIATION NO. 726 THEREBY APPROVING
THE REVISED SECOND STORY ADDITION AT 13 HEADLAND
DRIVE.
WHEREAS, the applicant, Mr. Duke Lin, has requested a
Height Variation to allow a first and second story addition at
13 Headland Drive at the proposed height of 24'-611, measured
pursuant to Section 17.02.040 of the Development Code; and
WHEREAS, on January 13, 1992 the Acting Director of
Environmental Services approved Height Variation No. 726 for a
first and second story addition at 13 Headland Drive; and
WHEREAS, on January 24, 1992, Mr. and Mrs. Marks filed
a written appeal within 15 days of the Acting Director's
decision to the Planning Commission; and
WHEREAS, after notice issued pursuant to the City's
Development Code, a public hearing was held on April 15, 1992
and May 12, 1992 at which time all interested parties were
given the opportunity to be heard and present evidence; and
WHEREAS, based on the direction provided by the
Planning Commission on April 15, 1992, the applicant redesigned
the project to lower the ridge height from 22'-6" and to move
the second story addition further north over the existing home
to preserve the view of Mount Baldy, as viewed from 7 Headland
Drive (appellant property).
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS
FOLLOWS:
Section 1: That pursuant to Section 17.02.040 of the
Development Code and the Height Variation Guidelines, the
applicant has complied with the provisions set forth for early
neighborhood consultation, in that they discussed the proposed
project with 80 % of the neighbors within a 100 foot radius and
40 % within 500 feet of the subject property.
Section 2: That the applicant erected a temporary space
frame to represent the outline of the proposed addition; the
height and location of which was verified by Staff.
Section 3: That the structure does not significantly
impair a view or vista from public property (parks, major
thoroughfare, bikeway, walkway, equestrian trail etc.) which
has been identified in the City's General Plan, Coastal
Specific Plan or City approved viewing area.
Section 4: That the proposed structure is not located on
a ridge or promontory.
Section 5: That no significant cumulative view impairment
would be caused by granting the application since the
residences on the south side of Headland Drive are located
downslope of the street and similar second story additions
would not impair views from properties on the north side of
Headland Drive.
Section 6: That the portion of the proposed structure
over 16 feet in height when considered exclusive of foliage,
does not significantly impair a view primary view from the
viewing areas at 7 Headland Drive. The re -designed project
will preserve the view of Mount Baldy.
Section 7: That the first and second story additions would
have exterior finishes that are compatible with other existing
residences in the neighborhood. Although the proposed
residences would be larger than other homes in the area, due to
the large size of the lot (I acre) and the substantial setbacks
between residential structures, the residence would be
compatible with the neighborhood character of the area.
Section 8: That the proposed project complies with all
other requirements of the Development Code.
Section 9: For the foregoing reasons and based on
information and findings included in the Staff Report and
evidence presented at the public hearing, the Planning
Commission of the City of Rancho Palos Verdes hereby denies the
appeal of Height Variation No. 726, thereby approving the
redesign of the first and second story addition at 13 Headland
Drive, subject to the conditions of approval attached in
Exhibit "All which are necessary to protect the public health,
safety and welfare.

1. The property owner must submit a notarized covenant to
protect views to the Department of Environmental services
or Staff shall conduct a vegetation analysis prior to the
issuance of building permits.
2. The following minimum setbacks shall be maintained for the
lower and upper story additions:
front yard; 201- 011
rear yard; 15-1- of$
side yards; 51- 011
3. Maximum eave projections shall not exceed 411 for each 1
foot of required setback.
4. Maximum height of the structure shall not exceed 221- 611
Certification of the ridgeline shall be required.
5. Grading shall not exceed 20 cu. yds. (including cut and
fill).
6. The lot shall maintain a minimum of 600 open space.
7. The property owner shall complete and notarized a covenant
which states that no windows will be placed on the second
story addition located on the south elevation of the
residence. Said covenant shall be submitted to the City of
Environmental Services Department prior to the issuance of
building permits.
