RESOLUTION NO. 92-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING EXTREME SLOPE NO. 30 FOR A DECK TO ENCROACH 6 FEET OVER AN EXTREME SLOPE AT 28864 CRESTRIDGE. WHEREAS, Almis and Rita Kuolas submitted Extreme Slope No. 30 on November 13, 1991, to allow a cantilevered wooden deck to encroach six feet over an extreme slope. WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on May 12, 1992, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES THEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property, since the lot contains a very limited amount of usable yard area due to the extreme slope which occupies approximately 50 percent of the lot and that the extraordinary condition on the applicant's property does not apply generally to the remainder of properties in the surrounding neighborhood. Section 2: That an extreme slope permit is necessary to preserve or allow the enjoyment of a substantial property right to the application which is possessed by other property owners under similar conditions in the same zoning district, since the surrounding properties have ample usable outdoor living areas. Section 3: That the granting of an extreme slope permit will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since the proposed deck would not impair the views, or adversely impact the privacy of surrounding residences and is screened from view from the public right-of-way by existing foliage. Section 4: That the extreme slope permit is not contrary to the provisions of the General Plan since their proposed deck would not alter the existing residential use of the site and is in conformance with all land use control elements in the General Plan. Section 5: For the foregoing reasons and based on information and findings included in the staff report, minutes and evidence presented at the public hearing, the Planning Commission of the City of Rancho Palos Verdes hereby approves Extreme Slope No. 30 thereby approving a 272 square foot cantilevered wooden deck to extend 6 feet onto an extreme slope subject to conditions of approval attached in Exhibit "A", which are necessary to protect the public health, safety, and welfare. Resolution No. 92- 33 Page 2 EXHIBIT "All EXTREME SLOPE PERMIT NO. 30 28864 CRESTRIDGE 1. The applicant shall submit a landscape plan to screen the view of the deck from surrounding properties. Landscaping shall consist of drought tolerant, low maintenance, and erosion controlling plant materials. Plant materials shall also blend with the native vegetation in the area. The landscaping and irrigation plan shall be submitted prior to building permit issuance and installed prior to building final. 2. Any disturbance to the surrounding slopes shall be restored and recompacted to pre -construction conditions. If existing landscaping on the slopes is removed or destroyed it shall be replaced in accordance with Condition No. 1. 3. In accordance with the provisions of 17.57.060, the deck shall be of color that blends with the natural landscape and maintenance thereof and shall subject to approval be the Director of Environmental Services prior to painting. 4. A Second Unit Covenant shall be required for the guest house/studio and kitchen facilities that would include a sink and a stove shall be prohibited. P.C. Resolution No. 92-33 Page 3
