A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES APPROVING •
VARIANCE NO. 328 TO ALLOW A 51" WALL WITHIN THE
FRONT SETBACK AT 5349 MANITOWAC.
WHEREAS, Mr. Besse has requested a Variance to allow an
existing 51" freestanding wall in the front yard setback at
5349 Manitowac; and
WHEREAS, after notice issued pursuant to the provisions
of the Rancho Palos Verdes Development Code, a public hearing
was held on April 28, 1992, at which time all interested
parties were given an opportunity to be heard and present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1: That there the subject property is a flat
pad with the exception of a one foot drop in grade between
the sidewalk and front lawn area which is an extraordinary
circumstance not normally found within the neighborhood.
Section 2 : That the Variance for the nine inch height
increase over the permitted forty-two inches in the front
setback is considered to be a minor and does not grant the
applicant a significant property right beyond that enjoyed by
other properties in the neighborhood.
Section 3 : That the granting of the Variance would
not be materially detrimental to the public health, safety
and welfare since the height and placement of the wall will
not interfere with pedestrian traffic, impact the views of
adjacent property owners or create a wall that is visually
obtrusive.
Section 4: The granting of the variance will not be
contrary to the objectives or the policies and requirements
of the General Plan or the policies and requirements of the
Coastal Specific Plan because there is no change in the
residential land use and the property is not located within
the coastal zone.
Section 5: For the foregoing reasons, and based on
the information contained in the Staff Report, minutes and
evidence presented at the public hearing, the Planning
Commission at the City of Rancho Palos Verdes hereby approves
Variance No. 328 to allow a freestanding wall in the in the
front setback with a maximum height of 51" .
