Resolution No. 92-22 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES UPHOLDING THE APPEAL ON MINOR EXCEPTION PERMIT NO. 429 THEREBY DENYING THE REQUEST FOR AN AFTER -THE -FACT 75 SQUARE FOOT STORAGE SHED THAT WOULD ENCROACH 20 PERCENT INTO THE 15 FOOT REAR YARD SETBACK AT 27892 PALOS VERDES DRIVE EAST. WHEREAS, Steve Chang has requested a Minor Exception Permit to approve an after -the -fact storage shed that encroaches into the rear yard setback at 27892 Palos Verdes Drive East; and WHEREAS, on December 3, 1991 the Director of Environmental Services approved Minor Exception Permit No. 429 for a 3 foot or 20 percent encroachment of a storage shed into the rear yard setback; and WHEREAS, on December 18, 1992 Pat Brown and Marilyn Sue Pike filed a written appeal to the Planning Commission within 15 days of the decision of the Director of Environmental Services; and WHEREAS, after notice issued, pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on March 24, 1992 by the Planning Commission to consider the appeal of Minor Exception Permit No. 429 at which time all interested parties were given the opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS Section 1: That there are no practical difficulties or unnecessary hardships associated with the subject property since there is space on the 3,600 square foot lot to accommodate an alternative location for the shed outside the required setback areas. Section 2: That the denial of the Minor Exception Permit will not create results that are inconsistent with the general intent of the Development Code since the landowner's ability to develop and use the subject property as a single family residence will not be altered in any manner. Section 3: For the foregoing reasons and based on the information and findings included in the staff report, minutes and evidence presented at the public hearing, the Planning Commission of the City of Rancho Palos Verdes hereby upholds the appeal of Minor Exception Permit No. 429 thereby denying the applicants request for a 20 percent rear yard encroachment for a 75 square foot storage shed at 27892 Palos Verdes Drive East.
