P.C. RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES APPROVING
GRADING PERMIT NO. 1548 AND VARIANCE NO. 317
TO ALLOW AN 8' RETAINING WALL WITHIN THE
FRONT SETBACK AND IN AN EXTREME SLOPE.
WHEREAS, Mr. and Mrs. Lebental have requested Grading
Permit and Variance to allow an 8 foot retaining wall in an
extreme slope and in the front yard setback at 9 Via Subida;
and
WHEREAS, after notice issued pursuant to the provisions
of the Rancho Palos Verdes Development Code, a public hearing
was held on March 25, 1992, at which time all interested
parties were given an opportunity to be heard and present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1: That there are exceptional or
extraordinary circumstances or conditions applicable to the
property which do not apply generally to other properties, in
the same zoning district, due to the topography of the site
and the angle of the front property line the existinggarage
and driveway area encroach into the front setback, which
makes expansion of the parking facilities outside the extreme
slope area and the front setback difficult.
Section 2 : That the Variance is necessary for the
preservation and enjoyment of a substantial property right of
the landowner since the construction of a 42" high retaining
wall within the front yard setback would not be sufficient to
retain the existing slope and create adequate access to the
off-street parking area. Similar RS-2 properties generally
have adequate level area in the side yard to accommodate off-
street vehicular storage.
Section 3 : That the granting of the Variance will not
be materially detrimental to the public health, safety and
welfare because the enclosed parking area will provide off-
street parking and the vehicles will be screened from the
street and adjacent properties and will not adversely impact
the privacy or primary views of the surrounding properties.
Section 4: The granting of the variance will not be
contrary to the objectives or the policies and requirements
of the General Plan or the policies and requirements of the
Coastal Specific Plan because there is no change in the
residential land use and the property is not located within
the coastal zone.
Section 5: For the foregoing reasons, and based on
the information contained in the Staff Report, minutes and
evidence presented at the public hearing, the Planning
Commission at the City of Rancho Palos Verdes hereby approves
Grading Permit No. 1589 and Variance 317 to allow a 580
square foot parking area and construction of an 8' retaining
wall in an extreme slope and in the front setback, subject to
the conditions of approval required in the attached Exhibit
"A" which are necessary to protect the public health, safety
and welfare.

Exhibit "A"
9 Via Subida
1. The property owner shall submit a notarized covenant to
protect views to the Department of Environmental Services
prior to the issuance of building permits.
2 . The maximum allowable grading shall not exceed 68 cubic
yards with a max. depth cut of 8 feet.
3 . The retaining wall at the toe of the extreme slope on the
west side of the property shall not exceed a max. height of
8 feet.
4 . Retaining walls adjacent to the driveway between the garage
and the front property line and along the staircase shall
not exceed 3 '-6" in height.
5. Lot coverage shall not exceed 40% of the property.
6. All pilasters within the front setback shall not exceed 42"
in height.
7. A variance application is required for any enclosure of the
off--street parking area adjacent to the garage on the west
elevation.
8 . The parking area in the west side yard shall not exceed 580
sq. ft.
9 . The skylight shall not exceed 18 ' in height and is limited
to 6" above the roof eave.
