A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 316 TO ALLOW FOR AN EXISTING
DECK TO BE LOCATED OVER AN EXTREME SLOPE
AT 2144 CHANDELEUR DRIVE.
WHEREAS, Mr. and Mrs. Antonino Russo have requested a
Variance to allow for an after -the -fact 637 square foot deck over
an extreme slope at 2144 Chandeleur Drive; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on February 25, 1992, at which time all interested parties
were given an opportunity to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved,
or to the intended use of the property, which do not apply
generally to other property in the same zoning district in that
even though the subject property is 25,100 square feet in overall
area, much of it is undevelopable (per the City's development
standards) due to the physical characteristics of the lot. The
severity of the slopes at the rear of the property create a
hardship on the applicants from developing the property as could
be done so on a lot that is not as physically restricted.
Section 2: That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions in the same zoning district since the applicants
are not able to increase the usable area of the property, an
improvement (right) enjoyed by other property owners throughout
the area, without the granting of the Variance. The canyon that
forms at the rear of the properties along Chandeleur Drive
leaves little to no rear yard area for most of these properties
and thus other decks similar to that of the applicants also exist.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located since Staff has conducted a view analysis from homes in
the area and has determined that the deck does not impair views
from any of these homes. The deck is not visually obtrusive, but
because of the overall height, Staff will recommend that the base
of the deck (structural members) should be screened with
vegetation.
Section 4: That the granting of such a Variance will not be
contrary to the objectives of the General Plan or the policies and
requirements of the Coastal Specific Plan since the General Plan
promotes improvements to existing residences as long as optimum
local standards of housing quality and design are maintained. The
constructed deck certainly does not detract from the neighborhood
(Staff has not received any letters in opposition to the request)
and allows the applicants to further enjoy the use of their
property. The property is not located within the Coastal
District.
Section 5: For the foregoing reasons and based on information
and findings included in the Staff Report, as well aspublic
testimony at the public hearing, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 316
subiect to the conditions of approval contained in the attached
Exhibit "A", which are necessary to protect the public health,
safety, and welfare.

EXHIBIT "A"
VARIANCE NO. 316
2144 Chandeleur Drive
1) The applicants shall obtain all necessary Building Permits from
the City's Building and Safety Division.
2) The applicant shall provide a Landscape plan to be approved
by the Director of Environmental Services for the area
immediately south (adjacent) of the deck. Landscaping shall be
provided to screen at least the lower six feet (6'-011) of the
deck structure.
3) The deck shall be maintained in a color that blends with the
natural landscape. The Director of Environmental Services
shall approve any change in color of the deck from the existing
medium brown.
