A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DENYING THE APPEAL OF HEIGHT
VARIATION NO. 704 -REVISION THEREBY UPHOLDING THE
DIRECTOR'S APPROVAL OF A SECOND STORY ADDITION AT 3103
DIANORA DRIVE.
WHEREAS, on November 5, 1990 the applicants, Mr.and Mrs. Phil
Peterson, submitted Height Variation No. 704 to allow a second
story addition at 3103 Dianora Drive; and
WHEREAS, on August 1, 1991 the applicants withdrew their
original proposal for Height Variation NO. 704 and submitted a
revised proposal identified as Height Variation No. 704 -Revision;
and
WHEREAS, on November 1, 1991 the Director of Environmental
Services approved with conditions Height Variation No. 704 -Revision
for a second story addition to an existing one-story residence with
a maximum height of 2416"; and
WHEREAS, on November 14, 1991 the Director's decision was
appealed by Mr. and Mrs. Norman Geis, property owners at 3351
Deluna Drive; and
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearing was held on
February 11, 1992, at which time all interested parties were given
an opportunity to be heard and present evidence:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That the applicant has complied with the early
neighbor consultation process established by the City by submitting
an Early Neighbor Consultation form with signatures of 70% of the
residents within a 100 foot radius and 25% of the residents within
a 500 foot radius.
Section 2: That the structure does not significantly impair
a view from public property (parks, major thoroughfares, bikeways,
walkways, equestrian trails) which has been identified in the
City's General Plan or a city designated viewing area.
Section 3: That the proposed structure is not located on a
ridge or a promontory.
Section 4: That the structure is designed and situated in
such a manner as to minimize impairment of a view in that the
structure is located at a lower elevation than the properties from
which view impairment would be expected.
Section 5: That there is no significant cumulative view
impairment caused by granting the height variation since the
applicant's residence and other adjoining residences are situated
on pads at varying elevations below the view from upslope
properties from which view impairment would be expected.
Section 6: That the proposed structure, when considered
exclusive of existing foliage, does not significantly impair a view
from the viewing area of another parcel, located in a portion of a
structure which was constructed without a height variation or
variance, or which would not have required a height variation or
variance when originally construct had this section as approve by
the voters on November 7, 1989, been in effect at the time the
structure was constructed.
Section 8: That the proposed structure, as presented to and
modified by the Planning Commission, is compatible with the
immediate neighborhood character in that the articulation and
placement of the second story reduces the apparent bulk and mass of
the structure. The addition utilizes architectural styles and
materials predominant in the neighborhood, respects all setbacks
and involves no added lot coverage.
Section 9: 'For the foregoing reasons and based on the
information and findings included in the Staff Report and records
of the proceedings, the Planning Commission hereby denies the
appeal of this project, thereby approving Height Variation No. 704 -
Revision subject to the conditions contained in the attached
Exhibit "A", which are necessary to protect the public health,
safety and welfare.
PASSED, APPROVED, and ADOPTED THIS 25th day of February, 1992.

EXHIBIT "A"
Conditions of Approval
Height Variation No. 704 - Revision
3103 Dianora Drive
1. The maximum height of the second story addition shall not
exceed 24 feet 6 inches (as measured pursuant to Section
17.02.040 of the Development Code).
2. A Landscape Covenant shall be completed, notarized, and
submitted prior to issuance of building permits.
3. The architectural design elements of the proposed
addition as shown on the plans presented to and approved
by the Planning Commission, including but not limited to
the configuration, size, and situation of the second
story footprint, the facade treatment (wood siding) and
roof design and treatment (composition asphalt shingles)
shall be utilized in the construction of the second story
addition. Any deviations from the approved architectural
design elements shall require approval by the Director of
Environmental Services.
4. All required setbacks and allowable eave projections
shall be adhered to.
5. No grading shall be permitted in association with this permit.
