A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING EXTREME SLOPE NO. 29 FOR
A DECK TO ENCROACH 6 FEET OVER AN EXTREME SLOPE AT 3141
DELUNA.
WHEREAS, Dr. Andrew Hajduczek submitted Extreme Slope No. 29
on October 1, 1991, to allow a wooden deck to encroach six feet
over an extreme slope.
WHEREAS, after notice pursuant to the City's Development
Code, a public hearing was held on January 14, 1992 at which time
all interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES THEREBY FIND, DETERMINE, AND RESOLVE AS
FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property, since the
lot contains a very limited amount of usable yard area due to
the extreme slope which occupies approximately 77 percent of the
lot and that the extraordinary condition on the applicant's
property does not apply generally to the remainder of properties
in the surrounding neighborhood.
Section 2 : That an extreme slope permit is necessary to
preserve or allow the enjoyment of a substantial property right to
the applicant which is possessed by other property owners under
similar conditions in the same zoning district, since the
surrounding properties have ample usable outdoor living areas.
Section 3 : That the granting of an extreme slope permit will
not be materially detrimental to the public welfare or injurious
to property and improvements in the area in which the property is
located, since the proposed deck would not impair the views or
adversely impact the privacy of surrounding residences and is
screened from view from the public right of way by existing
foliage.
Section 4: That the extreme slope permit is not contrary to
the provisions of the General Plan since the proposed deck would
not alter the existing residential use of the site and is in
conformance with all land use control elements in the General
Plan.

Section 5: For the foregoing reasons and based on
information and findings included in the staff report, minutes and
evidence presented at the public hearing, the Planning Commission
of the City of Rancho Palos Verdes hereby approves Extreme Slope
No. 29 thereby approving a 336 square foot cantilevered wooden
deck to extend 6 feet onto an extreme slope subject to conditions
of approval attached in Exhibit "A", which are necessary to
protect the public health, safety and welfare.

Exhibit A
1. In accordance with the provisions of 17.57. 060, the deck
shall be of color that blends with the natural landscape
and maintenance thereof and shall subject to approval by
the Director of Environmental Services prior to painting.
2 The proposed deck shall be screened from adjoining
residences by planting vegetation or placing an opaque
fence at the base of the deck along the west side property
line. If the applicant chooses to use vegetative screening,
a landscape plan indicating such screening shall be
submitted to the Acting Director of Environmental Services
for review.
3 Vegetative screening for the deck shall not exceed a height
of 6 feet.
4 No grading or other disturbance shall be permitted on the
extreme slope.
5. All other conditions of approval related to GR 1587 shall
apply to this approval.
