RESOLUTION NO. 92-1
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES DENYING
VARIANCE NO. 311 AND COASTAL PERMIT NO. 308
TO ALLOW A REDUCTION IN THE FRONT YARD SETBACK
AND TO EXCEED THE 250 SQUARE FOOT ADDITION
LIMITATION TO ACCOMMODATE ADDITIONS TO AN
EXISTING RESIDENCE AT 96 YACHT HARBOR DRIVE.
WHEREAS, the applicants, Mr. and Mrs. Tor Petterson, have
requested a Variance application and a Coastal Permit to allow for
encroachment into the required side yard setback and to exceed the
250 square foot addition limitation of the Code for additions to
an existing residence; and
WHEREAS, after notice pursuant to the provisions of the
Rancho Palos Verdes Development Code, a public hearing was held on
November 26, 1991, at which time all interested parties were given
an opportunity to be heard and present evidence:
NOW THEREFORE THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are no exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
• within the Portuguese district, in that other homes Bend Club have
similar problems with settling and cracking foundations, and have
been required to repair them without tearing down the structure
and without adding square footage of the magnitude requested (1137
square feet) in this application.
Section 2 : That the scope of this Variance request exceeds
that which is necessary for the preservation and enjoyment of a
substantial property right of the applicants. Further, said
request far exceeds the rights enjoyed by other property owners
under like conditions in that the request is for a tear-down of an
existing structure and enlargement of the building footprint by
1137 square feet in an area seaward of the Coastal Setback Line
where only 250 square feet of new floor space is permitted.
Therefore, the scope of the application falls beyond the purview
of the authority of the Planning Commission.
Section 3 : That the granting of the Variance would be
materially detrimental to the public welfare in that the scope of
the project far exceeds the limitations set forth by the Code and
has not been permitted for other property owners in its district.

Section 4: That the granting of such a Variance would be
contrary to the goals and policies of the Coastal Specific Plan it
specifies that much of the "Portuguese Bend" subregion possesses
geologic problems which preclude any new development, and a
project of this magnitude is considered to be new development.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff Report and records
of the proceedings, the Planning Commission hereby denies Variance
No. 311 and Coastal Permit No. 105.
PASSED, APPROVED, AND ADOPTED THIS 28th day of January, 1992.
