A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 299 FOR A SECOND STORY ADDITION
WHICH WILL ENCROACH A MAXIMUM OF 5 FEET INTO
THE FRONT YARD SETBACK AT 28614 MT. SAWTOOTH DRIVE.
WHEREAS, Mr. Paul Harris has requested a Variance to allow a
460 square foot second story addition whose maximum height will be
2412" to encroach five feet into the required twenty foot front
yard setback; and
WHEREAS, after notice issued pursuant to the provisions of
the City's Development Code, the Planning Commission held a public
hearing on October 22, 1991, at which time all interested parties
were given an opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are extraordinary conditions
applicable to the subject property which do not generally apply to
other property in the same zoning district in the size of the
subject property is almost 44% smaller than the minimum lot size
requirement for newly created lots in the same zoning district.
Section 2: That the Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions. This variance is necessary since the right to
build an addition of this size onto a comparably sized existing
structure is a right possessed by other property owners under like
conditions in the same zoning district.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located in that the scope of the proposed construction activity is
relatively minimal, and the design of the project will not
adversely affect surrounding views.
Section 4: That the granting of the Variance will be in
accordance with the objectives of the General Plan since the
property already exists as a single family residence. The
property is not located within any Coastal Specific Plan area.
Section 5: That the proposed second story addition of two
bedrooms, a bathroom and storage area meets the intent of the
City's Development Code.
Section 6: For the foregoing reasons and based on
information and findings included in the Staff Report, the
Planning Commission of the City of Rancho Palos Verdes hereby
grants Variance No. 299 for the use described herein.

1. Landscape covenant must be submitted prior to issuance of
building permits.
2. Minimum setbacks for addition: 151011 front; 51011 side
3. Any future additions reducing open space to less than 50% will
require a Minor Exception Permit or Variance application.
4. Maximum ridgeline height of addition: 2412". Critical --
Ridgeline Certification Required.
