RESOLUTION NO. 91-57 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION OF ENVIRONMENTAL ASSESSMENT NO. 629 FOR AN AMENDMENT TO CHAPTER 15.20 OF THE MUNICIPAL CODE. WHEREAS, on September 3 , 1991 , the City Council directed Staff to present proposed recommendations to the Planning Commission regarding amendments to Chapter 15 . 20 of the Municipal Code, entitled "Moratorium on Land Use Permits" ; and WHEREAS, a Subcommittee of the City Council and Planning Commission held noticed public workshops on September 13, 25 and October 2 , 1991 and which Subcommittee gave direction and made decision upon final formulation of the amendment; and WHEREAS, after notice pursuant to the provisions of the Rancho Palos Verdes Municipal Code, public hearings were held on October 8 and October 22 , 1991 , at which time all interested parties were given an opportunity to be heard and present evidence regarding the amendment; and WHEREAS, Environmental Assessment No. 629 was prepared in accordance with the State of California Environmental Quality Act and the State of California Environmental Quality Act Guidelines for said amendment, after which a Draft Negative Declaration was prepared, as set forth in Exhibit "A" attached hereto; and WHEREAS, the City issued a public notice for the determination of a Draft Negative Declaration on October 5, 1991 which public comment period shall run for 30 days, through November 4, 1991 . NOW THEREFORE, the Planning Commission of the City of Rancho Palos Verdes does hereby resolve that they have reviewed and considered the contents of Environmental Assessment No. 629 and find that there will be no significant adverse environmental impacts resulting from the project, and therefore, the Planning Commission recommends to the City Council that the Negative Declaration for the amendment to Chapter 15 . 20 of the Municipal Code be adopted. The City of Rancho Palos Verdes has initiated revisions to Chapter 15 . 20 of the Municipal Code, entitled "Moratorium on Land Use Permits. " The Planning Commission of the City will make recommendations to the City Council regarding the changes and the Council will act as the final decision making body. Pursuant to the authority and criteria contained in the California Environmental Quality Act and the California Environmental Quality Act Guidelines, the City of Rancho Palos Verdes , acting as the Lead Agency, has analyzed the project and determined that the project will not have a significant impact on the environment. Based on this finding, the Lead Agency prepared this NEGATIVE DECLARATION. A copy of the Initial Study, documenting reasons to support the finding, is attached. " The site is the area adjacent to the Pacific Ocean and Palos Verdes Drive South. This area includes an active landslide, scattered residential development, a major arterial , open space recreation, ocean viewing points and coastal beaches, limited agricultural , and institutions . The revisions to the text of the Municipal Code are an amendment to the Code falling under the General Provisions of Chapter 1 .01 , Adoption of Code, of the Municipal Code. Site on filled land or on slope of ten percent or more. X The City is located on the Palos Verdes Peninsula in the southwest tip of Los Angeles County. The formation of the Peninsula has resulted in the unique terrace configurations with steep rocky cliffs at the ocean' s edge. Within the City, a large portion of the City' s area consists of steeply sloping lands such that 40% to 50% of the land in the City are of a 25% slope or greater. But, again, the project, as defined, is not development specific and therefore does not propose to change slopes of areas . Any development project that is proposed would be required to comply with the standards setforth in Title 17 of the Municipal Code, the grading section in particular. X The proposed amendment to this chapter is related to other projects in that, if approved, will alter the development requirements for some. It is not expected that the development requirements will change for those projects which have applied for a building permit as of the date of final adoption of the amendment. ENVIRONMENTAL SETTING 32 . Describe the project site as it exists before the project, including information on topography, soil stability, plants and animals, and any cultural , historical , or scenic aspects. P.C. Resolution No. 91-57 page 10 411 410 • Describe any existing structures on the site, and the use of the structures. Attach photographs of the site. The project site includes approximately 1100 acres in the southern portion of the City (this is about one-seventh of the City' s area) adjacent to the Pacific Ocean and Palos Verdes Drive South including an unstable slide area along the coast. The Peninsula itself is a rugged area that is underlain by folded sedimentary rocks. Weak layers exist within these rocks and many massive ground failures have taken place during Holocene and late Pleistocene geologic times. Only one of the very large landslides,, the Portuguese Bend Landslide, is now active. Within the City, 40% to 50% of the land is of a 25% or greater slope. The moratorium area is situated on land containing steep slopes and marine terrace benches underlined with metamorphic rock and an overlay of sedimentary rock extends landward from the ocean. Due to sea cliff erosion hazards along most of the coastline in the moratorium area, special setback areas have been established with restrictions on certain types of construction. The focal point of the unstable topography in the area is Portuguese Canyon along with Klondike and Altimira Canyons . Population in the area is approximately 700 residents in mostly owner-occupied, single-family homes of a low density. Although the land which is now the City of Rancho Palos Verdes is rich in history and past cultures, the objects, sites, and structures of true historic significance are modest in number. The historic aspects within the moratorium area include: Portuguese Bend, which served as a pick-up point for smuggling operations when the land was ruled by Spanish Viceroys; Villa Francesca, the estate of Frank Vanderlip, principal founder and developer of much of the Peninsula; and the Portuguese Bend Riding Club. 33 . Describe the surrounding properties, including information on plants and animals and any cultural , historical , or scenic aspects. Indicate the type of land use (residential , commercial , etc . ) , intensity of land use ( single-family, multi-family, shops, department stores, etc. ) , and scale of development (height, frontage, set-back, rear yard, etc . ) . Attach photographs of the vicinity. The surrounding land use would have to be the surrounding single-family residential properties in Rancho Palos Verdes. They are of a slightly higher density than what is located in the moratorium area. Also, the surrounding cities include Rolling Hills, Rolling Hills Estates and Palos Verdes Estates . To the north is P.C. Resolution No. 91-57 page 11 111 110 Rolling Hills Estates. It is similar to Rancho Palos Verdes in that it is mostly single-family residential , with some commercial pockets. To the north-east is Rolling Hills, a completely gated, single-family residential community with typically large lots for equestrian accommodation. Palos Verdes Estates lies to the north-west and is, again, mostly single-family residential with some small commercial areas. ENVIRONMENTAL IMPACTS YES MAYBE NO 34. Earth. Will the proposal result in: a. Unstable earth conditions or in changes in geologic substructures? X b. Disruptions, displacements, compaction or overcovering of the soil? X c. Change in topography or ground surface relief features? X d. The destruction, covering or modification of any unique geologic or physical features? X e. Any increase in wind or water erosion of soils, either on or off the site? X f . Changes in deposition or erosion of beach sands, or changes in siltation, deposition or erosion which may modify the channel of a river or stream or the bed of the ocean or any bay, inlet or lake? X g. Exposure of people or property to geologic hazards such as earthquakes, landslides, mudslides, ground failure, or similar hazards? X The project, as described, will not result - in changes to earth resources, because it is not site specific ( it does not deal with a particular development proposal ) . The City' s goal is to preserve as much of the existing topography and geology as possible. This goal is reflected in the proposed revisions in that increased requirements for geological and/or geotechnical studies are proposed for certain construction. P.C. It is not the intent of the City to adversely affect the environment in such a way. b. Does the project have the potential to achieve short-term, to the disadvantage of long -term , environmental goals? (A short term impact on the environment is one which occurs in a relatively brief, definite period of time while long-term impacts will endure well into the future. ) X The Municipal Code is a long term document in itself, consistent with the General Plan of the City. The standards that are existing and the standards that are proposed are inherently long term provisions . c. Does the project have impacts which area individually limited, but cumulatively considerable? (A project may affect two or more separate resources where the impact on each resource is relatively small , but where the effect on the environment is significant. ) X Because the proposal is not for a specific development project, there are no individual impacts.
