Project: Revisions to Chapter 15 .20 of the Municipal Code,
Moratorium on Land Use Permits.
The City of Rancho Palos Verdes has initiated revisions to Chapter
15 . 20 of the Municipal Code, entitled "Moratorium on Land Use
Permits. " The Planning Commission of the City will make
recommendations to the City Council regarding the changes and the
Council will act as the final decision making body.
Pursuant to the authority and criteria contained in the California
Environmental Quality Act and the California Environmental Quality
Act Guidelines, the City of Rancho Palos Verdes , acting as the Lead
Agency, has analyzed the project and determined that the project
will not have a significant impact on the environment. Based on
this finding, the Lead Agency prepared this NEGATIVE DECLARATION.
A copy of the Initial Study, documenting reasons to support the
finding, is attached.
A period of 30 days from the date of publication of the notice of
this NEGATIVE DECLARATION will be provided to enable public review
of the project specifications, the Initial Study and this document
prior to the final adoption of the NEGATIVE DECLARATION by the Lead
Agency. A copy of the project specifications is on file in the

effects? Discuss below all items checked "yes" and "maybe. "
YES MAYBE NO
20. Change in existing features of any bays,
tidelands, beaches, lakes or hills, or
substantial alteration of ground contours. X
The project, as it is defined, will not make
any changes to such features because the
revisions are not site or project specific.
P.C. Resolution No. 91-57
page 5
111
YES MAYBE NO
Also, the City' s Coastal Specific Plan would
regulate any such changes or projects that
would create such changes . Even though the
revisions propose to alter the allowance of
some uses to the area, those uses would
still have to comply with existing grading,
coastal and overlay district regulations .

21 . Change in scenic views or vistas from
existing residential areas or public lands
or roads. X
There are expected to be no change in views.
Also, the City' s General Plan and Coastal
Specific Plan protect public and scenic
views from public vantage points. It is not
the intent of the project, as defined, to
amend either of these documents.

22. Change in pattern, scale or character of
general area of project. X
The majority of the revisions are merely
reorganizations and clarifications of
existing language. While added sections
( such as for additional allowable uses and
the codification of the existing exclusion
application policy) may change the scale or
development pattern of an individual lot,
the overall pattern of land use, overall
scale of development for the City as a
whole, and the existing character of the
area and City is expected to remain as is.

23 . Significant amounts of solid waste or
litter. X
The proposed revisions do not increase
current allowable densities in residential
areas nor do the revisions increase the
intensity of commercial or institutional
development. As proposed, any new open
space oriented, non-intensive, assembly uses
are not expected to significantly increase
the amounts of solid waste or litter enough
that there would be a significant adverse
impact upon the environment.

24 . Change in dust, ash, smoke, fumes or odors
in vicinity. X
The City does not expected any significant
adverse environmental impacts in this area
according to the reasons set forth in #23 ,
above.
25 . Change in ocean, bay, lake, stream or ground
water quality or quantity, or alteration of
existing drainage patterns. X
The City does not expected any significant
adverse environmental impacts in this area
according to the reasons set forth in #20 ,
above.
26 . Substantial change in existing noise or
vibration levels in the vicinity. X_
The City does not expected any significant
adverse environmental impacts in this area

Cod revisions (currently going through the
public hearing process before the City
Council ) address noise concerns with
requirements for sound-proofing in certain
development situations.
27 . Site on filled land or on slope of
ten percent or more. X
The City is located on the Palos Verdes
Peninsula in the southwest tip of Los
Angeles County. The formation of the
Peninsula has resulted in the unique terrace
configurations with steep rocky cliffs at
the ocean' s edge. Within the City, a large
portion of the City' s area consists of
steeply sloping lands such that 40% to 50%
of the land in the City are of a 25% slope
or greater. But, again, the project, as
defined, is not development specific and
therefore does not propose to change slopes
of areas . Any development project that is
proposed would be required to comply with
the standards setforth in Title 17 of the
Municipal Code, the grading section in
particular.

29. Substantial change in demand for municipal
services (police, fire, water, sewer, etc . ) . X
The City does not expected any significant
adverse environmental impacts in this area
according to the reasons set forth in #23,
above. Also, sewer hook-up for this area
would benefit the residents and it is
something that the City is currently
promoting.
30 . Substantially increase in fossil fuel
consumption (electricity, oil , natural gas,
etc. ) . X
The City does not expected any significant
adverse environmental impacts in this area
according to the reasons set forth in #23,
above.
31 . Relationship to a larger project or series
of projects . X
The proposed amendment to this chapter is
related to other projects in that, if
approved, will alter the development
requirements for some. It is not expected
that the development requirements will
change for those projects which have applied
for a building permit as of the date of
final adoption of the amendment.

ENVIRONMENTAL SETTING
32 . Describe the project site as it exists before the project,
including information on topography, soil stability, plants
and animals, and any cultural , historical , or scenic aspects.
P.C. Resolution No. 91-57
page 10

•
Describe any existing structures on the site, and the use of
the structures. Attach photographs of the site.
The project site includes approximately 1100 acres in the
southern portion of the City (this is about one-seventh of the
City' s area) adjacent to the Pacific Ocean and Palos Verdes
Drive South including an unstable slide area along the coast.
The Peninsula itself is a rugged area that is underlain by
folded sedimentary rocks. Weak layers exist within these
rocks and many massive ground failures have taken place during
Holocene and late Pleistocene geologic times. Only one of the
very large landslides,, the Portuguese Bend Landslide, is now
active. Within the City, 40% to 50% of the land is of a 25%
or greater slope. The moratorium area is situated on land
containing steep slopes and marine terrace benches underlined
with metamorphic rock and an overlay of sedimentary rock
extends landward from the ocean. Due to sea cliff erosion
hazards along most of the coastline in the moratorium area,
special setback areas have been established with restrictions
on certain types of construction. The focal point of the
unstable topography in the area is Portuguese Canyon along
with Klondike and Altimira Canyons .
Population in the area is approximately 700 residents in
mostly owner-occupied, single-family homes of a low density.
Although the land which is now the City of Rancho Palos Verdes
is rich in history and past cultures, the objects, sites, and
structures of true historic significance are modest in number.
The historic aspects within the moratorium area include:
Portuguese Bend, which served as a pick-up point for smuggling
operations when the land was ruled by Spanish Viceroys; Villa
Francesca, the estate of Frank Vanderlip, principal founder
and developer of much of the Peninsula; and the Portuguese
Bend Riding Club.
33 . Describe the surrounding properties, including information on
plants and animals and any cultural , historical , or scenic
aspects. Indicate the type of land use (residential ,
commercial , etc . ) , intensity of land use ( single-family,
multi-family, shops, department stores, etc. ) , and scale of
development (height, frontage, set-back, rear yard, etc . ) .
Attach photographs of the vicinity.
The surrounding land use would have to be the surrounding
single-family residential properties in Rancho Palos Verdes.
They are of a slightly higher density than what is located in
the moratorium area.
Also, the surrounding cities include Rolling Hills, Rolling
Hills Estates and Palos Verdes Estates . To the north is
P.C. Resolution No. 91-57
page 11
111 110
Rolling Hills Estates. It is similar to Rancho Palos Verdes
in that it is mostly single-family residential , with some
commercial pockets. To the north-east is Rolling Hills, a
completely gated, single-family residential community with
typically large lots for equestrian accommodation. Palos
Verdes Estates lies to the north-west and is, again, mostly
single-family residential with some small commercial areas.
ENVIRONMENTAL IMPACTS YES MAYBE NO
34. Earth. Will the proposal result in:
a. Unstable earth conditions or in
changes in geologic substructures? X
b. Disruptions, displacements, compaction
or overcovering of the soil? X
c. Change in topography or ground surface
relief features? X
d. The destruction, covering or
modification of any unique geologic or
physical features? X
e. Any increase in wind or water erosion
of soils, either on or off the site? X
f . Changes in deposition or erosion of
beach sands, or changes in siltation,
deposition or erosion which may modify
the channel of a river or stream or
the bed of the ocean or any bay, inlet
or lake? X
g. Exposure of people or property to
geologic hazards such as earthquakes,
landslides, mudslides, ground failure,
or similar hazards? X
The project, as described, will not result -
in changes to earth resources, because it is
not site specific ( it does not deal with a
particular development proposal ) . The
City' s goal is to preserve as much of the
existing topography and geology as possible.
This goal is reflected in the proposed
revisions in that increased requirements for
geological and/or geotechnical studies are
proposed for certain construction.

surface water runoff? X
c. Alterations to the course or flow of
flood waters? X
d. Change in the amount of surface water
in any water body? X
e. Discharge into surface waters, or in
any alteration of surface water
quality, including but not limited to
temperature, dissolved oxygen or
turbidity? X
f. Alteration of the direction or rate of
flow of ground waters? X
g. Change in the quantity of ground
waters, either through direct
additions or withdrawals, or through
interception of an aquifer by cuts or
excavations? X
h. Substantial reduction in the amount of
water otherwise available for public
water supplies? X
i. Exposure of people or property to
water-related hazards such as flooding
or tidal waves? X
j . Significant changes in the
temperature, flow, or chemical content
of surface thermal springs? X
The project is not expected to alter water
resources, because it is not site specific
and it does not deal with a particular
development proposal .

Therefore, no effect is anticipated in the
are of public facilities and services . The
proposed additional open space uses would
not be expected to adversely affect such
services.

The proposed do not increase densities in
residential areas nor do the revisions
increase the intensity of commercial or
institutional development. Therefore, no
effect is anticipated in the area of utility
and services . The revisions do propose
further requirements for property owners to
provide for future sewer hook-up which would
benefit the area and not harm it
environmentally.

51 . Aesthetics . Will the proposal result in the
obstruction of any scenic vista or view open
to the public, or will the proposal result
in the creation of an aesthetically
offensive site open to public view? X
There are expected to be no changes in views
associated with the proposed revisions.
Individual development proposals will be
required to comply with the view
preservation sections of the Municipal Code
(Title 17 ) . Also, the City' s General Plan
and Coastal Specific Plan protect public and
scenic views from public vantage points. It
is not the intent of the project, as
defined, to amend either of these documents.

52 . Recreation. Will the proposal result in an
impact upon the quality or quantity of
existing recreational opportunities? X
The revisions do propose additional uses
which are open space and recreational in
nature. However, an increase in densities
for residential areas is not proposed nor do
the revisions increase the intensity
of commercial or institutional development.
Therefore, there should be no impacts in the
quality or quantity of recreational
opportunities, since the proposal actually
promotes additional opportunities for such
non-intensive open space uses .

structure, or object? X
c . Does the proposal have the potential
to cause a physical change which would
affect unique ethnic cultural values? X
d. Will the proposal restrict existing
religious or sacred uses within the
potential impact area? X
The project, as described, will not result
in changes to cultural resources, because it
is not site specific (it does not deal with
a particular development proposal ) . Also,
the revisions proposed would not create such
change in existing cultural conditions.

54. Mandatory Findings of Significance.
a. Does the project have the potential to
degrade the quality of the
environment, substantially reduce the
habitat of a fish or wildlife species,
cause a fish or wildlife population to
drop below self-sustaining levels ,
threaten to eliminate a plant or
animal community, reduce the number or
restrict the range of a rare or
endangered plant or animal or

eliminate important examples of the
major periods of California history or
prehistory? X
As justified throughout this Environmental
Assessment, the proposal (to amend Chapter
15 .20 of the Municipal Code) is not site
specific . Although there are changes in the
text of the Code, those changes will help to
further protect the quality of the
environment, including wildlife and
California history. It is not the intent of
the City to adversely affect the environment
in such a way.
b. Does the project have the potential to
achieve short-term, to the
disadvantage of long -term ,
environmental goals? (A short term
impact on the environment is one which
occurs in a relatively brief, definite
period of time while long-term impacts
will endure well into the future. ) X
The Municipal Code is a long term document
in itself, consistent with the General Plan
of the City. The standards that are
existing and the standards that are proposed
are inherently long term provisions .
c. Does the project have impacts which
area individually limited, but
cumulatively considerable? (A project
may affect two or more separate
resources where the impact on each
resource is relatively small , but
where the effect on the environment is
significant. ) X
Because the proposal is not for a specific
development project, there are no individual
impacts. The revisions are internally
consistent and relate to the Municipal Code
as a whole.
d. Does the project have environmental
effects which will cause substantial

YES MAYBE NO
adverse effect on human beings, either
directly or indirectly? X
Again, the justifications and explanations
throughout this Environmental Assessment
show that the proposed revisions to the
Municipal Code are not site specific and
that although there are changes in the text
of the Code, those changes will help to
further prevent any adverse environmental
impacts on human beings, either directly or
indirectly.
