PC RES 1991-056 P.C. RESOLUTION NO. 91-56 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 306, TO ALLOW PILASTERS, A FOUNTAIN, AND AN ENTRY ARCHWAY TO REMAIN WITHIN THE FRONT YARD SETBACK AS CONSTRUCTED AT #1 AVENIDA DE MAGNOLIA. WHEREAS, Greg Abramowitz, representing the property owners, Mr. and Mrs. Steve Heboian, has requested a Variance to allow for after-the-fact improvements (pilasters, a fountain, and an entry archway) to remain within the front yard setback as constructed; and WHEREAS, notice was issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on October 8, 1991, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that, although the subject property is similar in area with the average lot (9, 023 sq. ft. ) in the tract, the area is significantly smaller than that of newly created RS-1 and RS-2 zoned lots (1 ac. and 20, 000 sq. ft. respectively) . Along with this smaller lot area, the shape of the subject lot, more specifically, the curvilinear south- east corner of the lot, further limits development since a portion of the corner is essentially cut off. Section 2 : That the Variance is necessary for the preservation and enjoyment of a substantial property right of the landowner, since the property owner is further restricted from developing the property in comparison to other property owners in the area due to the more constraining lot configuration. Section 3 : That the granting of the Variance will not be materially detrimental to the public health, safety, and welfare because the subject improvements have already received inspection from the City's Building and Safety . Division as to the structural aspects of said improvements. Section 4: That the granting of the Variance will not be contrary to the objectives of the General Plan since the Plan promotes the design of visually interesting, aesthetically pleasing residential neighborhoods to be maintained throughout the City and the subject improvements are nothing more than ornamental features to beautify the property. Section 5: For the foregoing reasons, and based on the information and findings provided in the Staff report, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 306 as submitted.
