RESOLUTION NO. 91-50 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING GRADING NO. 1552 FOR CONSTRUCTION OF A RETAINING WALL AT 30001 VIA RIVERA. WHEREAS, Mr. chin Lien Wang had constructed on his property at 30001 Via Rivera, without City approval, a wall within a 4 foot high, 35% transition slope area; the wall consisting of 4 feet of retaining wall below and 3 feet of freestanding wall above, with a total downslope height of -7 feet, which was constructed 1 foot to 3 feet inside the property's northern, side property line; and WHEREAS, this wall was found by the City Staff to be failing due to improper construction, Mr. Wang was required to obtain City approval for the proper stabilization of the wall and adjoining slope; and WHEREAS, Mr. Wang requested, through Grading No. 1552, approval of a retaining wall to be constructed against the property line, to stabilize the existing wall and adjoining slope, while also removing the 3 foot high non -retaining section of the existing wall while letting remain the 4 foot high retaining section of the existing wall; and WHEREAS, the Planning Commission of the City of Rancho Palos Verdes held public hearings on the item on July 30, 1991 and September 24, 1991, at which times all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the proposed wall should not be built but that the existing, non -permitted wall be removed and replaced with a legal, properly permitted, properly constructed and inspected wall of the same height and location. Section 2: That the grading is not excessive beyond that necessary for the permitted primary use of the lot in that although approval will result in a 4 foot high, downslope, retaining wall, no soil will need to be imported or exported though reconstruction of the existing, unpermitted, retaining wall will require grading activity. Section 3: That the grading and construction does not significantly adversely affect the visual relationships with, nor the views from, neighboring sites in that this approval may result in a wall with a total downslope height no greater than 7 feet and an upslope, exposed height of 3 feet, which will not be obstructing the view from the adjacent downslope property. Section 4: That the nature of the grading will minimize disturbance to the natural contours and will result in reasonably natural finished contours in that the retaining wall is replacing only a small 4 foot high transition slope along a common side property line. Section 5: For the foregoing reasons, and based on the information and findings provided in the Staff Reports, the Planning Commission of the City of Rancho Palos Verdes hereby approves Grading No. 1552 subject to the conditions outlined in the attached Exhibit "A". Resolution No. 91-50 Page 2 11 EXHIBIT "All GRADING PERMIT NO. 1552 CONDITIONS OF APPROVAL 1. Approval for the retaining wall must be obtained from the Building and Safety Division. 2. The maximum downslope height of the wall shall not exceed 71. 3. The location of the wall foundations shall be verified by a licensed land surveyor on a form provided by the Building Official. 4. Location shall be consistent with plans dated June 4, 1991, showing the wall 11-31 south of the northerly side property line. 5. The applicant shall submit to the City, prior to issuance of building permits, a "Covenant to Protect and Restore Views". P.C. Resolution No. 91-50 Page 3
