A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 305
AND GRADING PERMIT NO. 1538 AT 30138 AVENIDA
TRANQUILA.
WHEREAS, Hubert and Amelia Hemsley have requested a Variance
and Grading application to allow an addition to an existing
structure and a retaining wall in excess of eight feet to be built
in an extreme slope area; and
WHEREAS, notice issued pursuant to the provisions of the
Rancho Palos Verdes Development Code, a public hearing was held on
September 24, 1991, at which time all interested parties were
given an opportunity to be hard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, in that, although the property exceeds that minimum lot
size for the RS -3 zoning classification, approximately one-third
of the lot is undevelopable due to the ascending extreme slope at
the rear of the property.
Section 2: That the Variance is necessary for the
preservation and enjoyment of a substantial property right of the
landowner, since the property owner is further restricted from
improving this property due to the nature of the lot.
Section 3: That the granting of the Variance will not be
materially detrimental to the public health, safety, and welfare
because the additions and the retaining walls do not adversely
affect the privacy or views of adjacent properties.
Section 4: For the foregoing reason, and based on the
information and findings provided in the Staff Report, the
Planning Commission of the City of Rancho Palos Verdes hereby
approves Variance No. 305 and Grading Permit No. 1538 subject to
the conditions outlined in the attached Exhibit "A".
PASSED, APPROVED, and ADOPTED this 24th day of September
1991.

VARIANCE NO. 305 AND GRADING PERMIT NO. 1538
CONDITIONS OF APPROVAL
1. The maximum height of the additions shall not exceed the
existing ridge height of 133.5 feet.
2. Approval of the project is subject to approval from the
Division of Building and Safety.
3. Submittal of a "Covenant to Protect Views" prior to issuance
of building permits.
