A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 267 -REVISION, TO ALLOW A 287
SQUARE FOOT ADDITION AT 6925 ALTA VISTA DR.
WHEREAS, the applicant, Mr. Michael Chan, has requested a
Variance revision to allow a kitchen/dining room addition to the
rear of the existing residence; and
WHEREAS, after notice pursuant to the provisions of the
Rancho Palos Verdes Development Code, a public hearing was held on
August 27, 1991, at which time all interested parties were given
an opportunity to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved,
or to the intended use of the property, which do not apply
generally to other property in the same zoning district in that
the original Variance was required for the requested additions
because as a result of grading the lot by the developer, an
unusable slope was created in the middle of the lot and split the
developable area of the lot into two areas, the level front area
and the gentling sloping rear portion of the lot.
Section 2: That such a Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions in the same zoning district since several other
lots on the south side of Alta Vista Drive were developed as split
level homes in the same manner as was proposed by the applicant.
All of these homes step down with the slope and project over the
slope. Other homes in the Alta Vista tract are similar in size
with that of the applicant's. It is the Commission's opinion that
the applicant's limiting constraints due to the physical
topography of the lot and the general size and style of the
structure are similar to other properties in the area.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located in that a view analysis was conducted from 6933 Alta Vista
Drive and it was determined that only a small portion of the
property owner's views, (ocean, coastline, Catalina Island), will
be'impaired by the addition and the impairment is not considered a
significant view impairment.

It is therefore the Commission's opinion that there will be no
significant view loss from any properties in the area as a result
of the proposed additions.
The Development Code does not address the issue of invasion of
privacy with regard to Variance requests and therefore the
complainant's concern is without merit.
Section 4: That the granting of such a Variance will not be
contrary to the objectives of the General Plan since the property
is located in a residential area and the proposed development is
an expansion of the existing residential use. It is a goal of the
General Plan to promote a range of housing types and this proposal
is consistent with that goal.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff report and records
of the proceedings, the Planning Commission hereby approves
Variance No. 267 -Revision subject to the conditions of approval
attached as Exhibit "A".

1. Maximum height of addition shall not exceed existing ridge
height.
2. Minimum side yard setback shall be maintained: 10 feet.
3. Maximum eave projection shall not exceed 4" for each 1'-0" of
required setback.
