A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES DENYING
THE APPEAL OF HEIGHT VARIATION NO. 701 AT
2417 SUNNYSIDE RIDGE ROAD, THEREBY APPROVING
STAFF 'S APPROVAL OF THE PROJECT.
WHEREAS , the applicants , Andrew and Vicky Center, have filed
an application for a Height Variation to allow a second story
addition at a proposed height of 24 '0" , measured pursuant to
Section 17 .02 .040 of the Development Code , at 2417 Sunnyside Ridge
Road; and
WHEREAS , on June 13 , 1991 , notification of the Director of
Environmental Services ' decision to approve Height Variation No.
701 was mailed to all interested parties ; and
WHEREAS , on June 17 , 1991 , Edith Pearson filed an appeal of
the Director' s decision on behalf of the Sunnyside Community
Association; and
WHEREAS , after notice pursuant to the City's Development
Code, a public hearing was held on August 27 , 1991 , at which time
all interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That pursuant to Section 17 .02.040 of the
Development Code and adopted guidelines, the applicants have
complied with the provisions set forth for early neighborhood
consultation, in that they discussed the proposed project with the
neighbors within the vicinity and the Homeowner' s Association was
notified.
Section 2 : That the applicant constructed a temporary space
frame of the outline of the proposed addition on December 6, 1990 ,
the height and location of which were verified by Staff .
Section 3 : That the original design was felt to be
incompatible with the neighboring properties , and therefore the
project was redesigned.
Section 4: That the frame for the redesign was verified by •
Staff , and a new notice was mailed to all parties within a 500
foot radius on May 9, 1991 .
Section 5 : That the Director of Environmental Services
approved Height Variation No. 701 on June 11 , 1991 , with notices
being mailed to interested parties on June 13 , 1991 .
Section 6: That the Director' s decision was appealed by
Edith Pearson on behalf of the Sunnyside Community Association on
June 17 , 1991 .

Section 7 : That the structure does not significantly impair a
view or vista from public property (parks , major thoroughfare,
bikeway, walkway, equestrian trial , etc . ) which has been
identified in the City's General Plan, Coastal Specific Plan or
City-approved viewing area.
Section 8 : That the proposed structure is not located on a
ridge or promontory.
Section 9: That the proposed structure has been designed and
situated in such a manner as to minimize view obstruction and the
proposed two story residence would conform with the required front
and side yard setbacks.
Section 10 : That there would be no significant cumulative
impact caused by granting the application since there would be no
major incremental loss of views if subsequent second story
additions, situated in a similar manner and at a similar height ,
were approved.
Section 11 : That based on an analysis of the surrounding
vicinity, the proposed structure is compatible with the character
of the immediate neighborhood.
Section 12 : For the foregoing reasons, and based on
information and findings included in the Staff Reports , minutes,
records of proceedings, and evidence presented at the public
hearing , the Planning Commission of the City of Rancho Palos
Verdes hereby denies the appeal of Height Variation No . 701 ,
thereby upholding the Director's approval of said application,
subject to the conditions of approval contained in Exhibit "A,"
which are necessary to protect the public health, safety, and
general welfare in the area.
PASSED, APPROVED, and ADOPTED is 27th d of August , 1991 .

Height Variation No. 701
2417 Sunnyside Ridge Road
Conditions of Approval :
1 . Landscape covenant must be submitted prior to issuance of
building permits .
2 . Second Unit Covenant and Agreement must be submitted prior to
issuance of building permits .
3 . Ridgeline shall not exceed 24 '0" and tower feature shall not
exceed 21 '0" . Critical -- Certification Required.
4. Construction (including decks) in extreme slope areas are not
a part of this approval and will require separate
applications.
5 . The swimming pool is not a part of this approval .
