A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES ADOPTING THE
NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT
NO. 624 AND APPROVING CONDITIONAL USE PERMIT
NO. 164 TO ALLOW THE USE OF A ROOM, OFFICE AND
STORAGE AREA AT LADERA LINDA COMMUNITY CENTER
BY THE CANYON VERDE PENINSULA COMMUNITY COLLEGE
(CVPCC) FOR THE PURPOSE OF CONDUCTING A SCHOOL
FOR THE DEVELOPMENTALLY DISABLED.
WHEREAS, on May 13, 1991, Ms. Roslyn Stewart, submitted
Environmental Assessment No. 624 and C.U.F. No. 164 to the
Department of Environmental Services requesting the use of a room,
an office and storage area at the Ladera Linda Community Center
for the purposes of conducting a school for the developmentally
disabled population of the Peninsula and surrounding community;
and
WHEREAS, on July 30, 1991, Staff completed an Initial Study
of the project and determined that although the proposed project
could have a significant effect on the environment, there will not
be a significant effect in this case because the mitigation
measures have been added to the project which mitigate all
potential impacts to a level of insignificance; and
WHEREAS, after notice pursuant to the City's Development
Code, the Planning Commission held a public hearing on August 27,
1991, at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That the site for the intended use is adequate in
size and shape to accommodate the proposed use since the site was
previously used as an elementary school and continues to be
utilized as a site to hold City wide classes, events, and
community meetings and thus has all of the facilities, including
numerous recreational/athletic fields to accommodate the proposed
use.
Section 2: That the site for the proposed use relates to
streets and highways properly designed to carry the type and
quantity of traffic generated by the subject use since it is
accessed by one of the mayor arterial streets in the City, Palos
Verdes Drive South. It is Staff's opinion that because many of
the students will be using one form of public transportation or
another and since there will be a limited number of educational
staff members, that there will be no effect at all on the streets
of access.
Section 3: That in approving the subject use at the specific
location, there will be no significant adverse effect on adjacent
property or the permitted use thereof since the site and its
educational/recreational features are more than adequate to allow
the added use of the site by the CVPCC. It is Staff's opinion
that the school will have no effect on the existing available
parking on site due to the fact that the students will not be
driving themselves to the site and since there will only be a
handfull of staff members requiring parking spaces.
Section 4: That the proposed use is not contrary to the
General Plan since the General Plan's land --use map indicates that
the Ladera Linda site is a designated institutional (educational)
site and thus, the proposed use by the CVPCC will be consistent
with that specified land use.
It is a stated policy of the General Plan to "locate schools on or
near major arterials or collectors, buffered from residential
uses, and provide adequate parking and access exits." The Ladera
Linda Site is accessed by Palos Verdes Drive South, one of the
City's major arterial streets, the portable pod classrooms are
essentially shielded from adjacent residential communities by
surrounding athletic fields and playground areas, and as mentioned
previously, it is Staff's opinion that adequate parking and access
exists.
It is also a stated policy of the General Plan to "Encourage
additional institutions of higher learning and research...". The
applicant's proposal to form the Canyon Verde Peninsula Community
Center will provide a continued educational system along with
providing a source for vocational training, neither of which
currently exists for the developmentally disabled population of
the Peninsula.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff report and records
of the proceedings, the Planning Commission hereby adopts the
Negative Declaration for Environmental Assessment No. 624 and
approves Conditional Use Permit No. 164 subject to the conditions
of approval in Exhibit "A" which are necessary to protect the
public health, safety, and welfare.

CONDITIONS OF APPROVAL
ENVIRONMENTAL ASSESSMENT NO. 624
CONDITIONAL USE PERMIT NO. 164
CANYON VERDE PENINSULA COMMUNITY COLLEGE
LADERA LINDA COMMUNITY CENTER
32201 FORRESTAL DRIVE
1. Within thirty (30) days of this approval, the applicant shall
submit, in writing, a statement that she has read and
understands all conditions of approval. Failure to provide
such a statement shall render this approval null and void.
2. All conditions shall be complied with and 'maintained in a good
`faith effort from the applicant.
3. An enrollment limit of 30 students shall be established to
initiate review of the approved use to establish whether or
not adverse effects may occur as a result of increasing the
enrollment and establish any modifications, if any, to the
approval.
4. The applicant shall keep on file with the Department of
Environmental Services Department an student enrollment list
at all times to uphold Condition No. 3.
5. The applicant shall keep on file with the Department of
Environmental Services a list of educational staff members
(including volunteers) so that Staff can determine that the
State's student/instructor ratio requirement is met at all
times.
6. Educational staff members shall park only in the middle,
unpaved lot, north of the pod structures.
7. The applicant shall obtain approval from the Director of
Environmental Services prior to making any modifications or
additions to the site.
8. The applicant shall comply with all recommendations and
requirements, if any, of the City's Building and Safety
Division.
9. The applicant shall supply to the Department of Environmental
Services within sixty (60) days of this approval, a copy of
the license provided by the State Department of Social
Services Community Care Licensing Agency indicating compliance
with all State requirements and authorizing the operation of
the Canyon Verde Peninsula Community College on the Ladera
Linda site.

10. Unless the Department of Fish and Game determines that this
project is exempt from a filing fee imposed pursuant to Fish
and Game Code Section 711.4, the applicant shall submit to the
City payment of such fee made payable to the County Clerk of
Los Angeles, along with the County's documentation fee, not
later than 48 hours after project approval. The applicant
shall also be responsible for payment of any fines the
Department of Fish and Game determines to be owed. Project
approval is not operative, vested, or final until the filing
.fees are paid or a Certificate of Fee Exemption is properly
completed. A minimum fee of $25.00 for documentation handling
shall be submitted to the City within 48 hours of project
approval for processing of the Certificate of Fee Exemption
(De Minimus Impact Finding).
