A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES SUSTAINING THE APPEAL OF MINOR
EXCEPTION PERMIT NO. 415, THEREBY APPROVING A 6%
REDUCTION IN THE REQUIRED OPEN SPACE AT 30142 RHONE RD.
WHEREAS, on May 31 , 1991, the Director of Environmental
Services approved a portion of Minor Exception Permit No.
415 for a 6% reduction in open space to allow construction of
630 square feet of additional improvements;
WHEREAS, on June 14, 1991, Sam Houston filed an appeal
to the Planning Commission within 15 days of the decision of
the Director of Environmental Services; and
WHEREAS, on August_ 13, 1991, the Planning Commission
considered the appeal of Minor Exception Permit No. 415 at
which time all interested parties were given an opportunity
to be heard and present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND AND DETERMINE AND
RESOLVE AS FOLLOWS:
Section 1: The thirty percent slope in the front setback
necessitates a long driveway to reach the developable pad.
The driveway which constitutes 36% ( 2,260 sq. ft. ) of the lot
coverage on the property is necessary for access and a safe
turnabout and this creates a hardship for the property owner
to meet the open space requirement.
Section 2: That the 6% decrease in the 60% required open
space for the proposed additions on the property located in
the RS-2 zone is reasonable because the additions are minor
and together they only increase the lot coverage by 6% ,
which is well below the 20% a minor exception permit would
allow.
Section 3: That the granting of the minor exception
permit, with conditions will not confer a special privilege
to the applicant not enjoyed by other property owners because
the the applicant' s 15,000 square foot lot is substandard as
compared with a newly created lot in the RS-2 zone; the
property owner is at a disadvantage when it comes to an
increase lot coverage.
Section 4: For the foregoing reasons and based on
information and findings included in the staff report and
evidence presented at the public hearing, the Planning
Commission of the City of Rancho Palos Verdes thereby
approves the appeal of Minor Exception Permit No. 415 and
thereby allowing
all additions at 30412 Rhone Rd. subject to the conditions
of approval contained in Exhibit "A" of this Resolution.

MINOR EXCEPTION PERMIT NO. 415 APPEAL
1 . A Landscape covenant to protect views shall be submitted
by he property owner prior to the issuance of building
permits
2. Grading shall be limited to construction of foundations.
