A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
COASTAL PERMIT NO. 104 AND VARIANCE NO. 301
TO ALLOW 468 SQUARE FEET OF LIVEABLE AREA
AND 200 SQUARE FEET OF LOFT/STORAGE AREA
FOR A PROPERTY LOCATED IN THE COASTAL ZONE
AT 48 SEAWALL ROAD.
WHEREAS, Michael and Honeya Barth have requested a
Coastal Permit and Variance to exceed the 250 square foot
Code limitation for additions within the Coastal Zone at 48
Seawall Road; and
WHEREAS, the City Council approved Moratorium Exemption
No. 42 on Febraury 19, 1991, which granted authority for the
applicants to proceed with filing applications for Coastal
Permit No. 104 and Variance No. 301; and
WHEREAS, after notice issued pursuant to the provisions
of the Rancho Palos Verdes Development Code, a public hearing
was held on July 23, 1991 at which time all interested
parties were given an opportunity to be heard and present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1 : That the proposed development is in
conformance with the coastal specific plan.
Section 2: That the proposed development is located
between the sea and the first public road, and is in
conformance with applicable public access and recreation
policies of the Coastal Act.
Section 3: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which
do not apply generally to other properties in the same zoning
district, in that the lot size and dimensions are
substandard and do not meet the requirements of the RS-2
zoning district.
Section 4: That the Variance is necessary for the
preservation and enjoyment of a substantial property right of
the landowner, since the addition requested, although it
exceeds the 250 square foot Code limitation, is still within
the "minor" scope permitted in the Coastal Zone, and does not
result in a significant increase in building footprint.
Section 5: That the granting of the Variance will not
be materially detrimental to the public health, safety, and
welfare since there will be no increased water usage. The
applicant shall submit a soils report and comply with all
recommendations of the City' s geotechnical staff and the
existing and proposed improvements to the property do not and
would not adversely impact the privacy nor the views of the
surrounding properties.
Section 6: The existing and proposed development is in
conformance with the Coastal Specific Plan since the subject
property is not located in the Open Space Hazard Zone, the
requested additions will not change the present residential
use of the property or increase water usage and are
considered minor additions even though they exceed the 250
square foot limitation allowed in the Coastal Zone.
Section 7 : For the foregoing reasons, and based on
information and findings included in the Staff Reports,
minutes, records of proceedings, and evidence presented at
the public hearing, the Planning Commission of the City of
Rancho Palos Verdes hereby approves Coastal Permit No. 104
and Variance No. 301 subject to the conditions of approval
contained in Exhibit "A, " which are necessary to protect the
public health, safety, and general welfare in the area.
PASSED, APPROVED, and ADOPTED this 23rd day of July,
1991.

EXHIBIT "A"
Coastal Permit No. 104 and Variance No. 301
48 Seawall Road
1. Approve the application with the following conditions:
a) All original conditions for Landslide Moratorium
Exemption No. 42 must be satisfied prior to the
issuance of building permits.
b) No future reductions in open space will be permitted.
The property owner shall record a covenant, to run
with the land, prohibiting further additions,
habitable or non-habitable, on the subject property.
Said covenant shall be recorded prior to issuance of
building permits.
c) Should the garage expansion occur, a minimum of two
parking spaces must be enclosed and conform to
Building and Safety standards.
d) Landscape Covenant must be submitted prior to
issuance of building permits.
e) Expansion of water and sewer hook-ups are not
permitted.
