PC RES 1991-026P.C. RESOLUTION NO. 91-26 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 295 TO ALLOW CONSTRUCTION INTO AN EXTREME SLOPE FOR ADDITIONS AT 28866 CRESTRIDGE. WHEREAS, the applicant, Stevie Bei.tsher, has requested a Variance application to allow for construction into an extreme slope for additions to the existing structure; and WHEREAS, after notice pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on June 11, 1991, at which time all interested parties were given an opportunity to be heard and present evidence: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that the property is broken up into two distinguished pad levels by several transitional extreme slopes. Although the gross lot area exceeds the minimum required area for newly created RS -2 zoned lots, the transitional slopes significantly reduce the developable area of the lot. Section 2: That such a Variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, since the applicant is restricted to the areas of the property which can be developed due to the transitional slopes throughout the property. Section 3: That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since the proposed additions will not cause view impairment from surrounding properties and will be erected according to Building and Safety standards. Section 4: That the granting of such a Variance will not be contrary to the objectives of the General Plan since the additions will not alter the residential use of the property. The property is not located within the Coastal Specific Plan District. Section 5: For the forgoing reasons and based on the information and findings included in the Staff report and records of the proceedings, the Planning Commission hereby approves Variance No. 295 subject to the conditions contained in Exhibit "A" attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. The applicant shall complete, notarize, and submit a Covenant to Protect Views to the Department of Environmental Services prior to the issuance of final Building Permits. 2. The maximum height of the addition shall not exceed 12 feet in height, or an elevation of 152.0 feet. 3. Maximum allowable eave projections shall not exceed 4 inches for each 1'-0" of required setback. 4.
