A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES
APPROVING VARIANCE NO. 289, TO ALLOW A
PORTION OF A DECK TO PROJECT FURTHER
THAN 6 FEET OVER AN EXTREME SLOPE AT 2612
COLT ROAD.
WHEREAS, the applicant, Mr. Layton Carr, has requested a
Variance application to allow for a portion of a new deck to
extend further than the allowable 6 foot projection over an
extreme slope; and
WHEREAS, after notice pursuant to the provisions of the
Rancho Palos Verdes Development Code, a public hearing was held on
June 11, 1991, at which time all interested parties were given an
opportunity to be heard and present evidence; and
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY,OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property which do
not apply generally to other properties in the same zoning
district, in that a significant portion of the applicant's
property is undevelopable due to a descending extreme slope
located in the rear yard.
Section 2: That such a Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, since the applicant is unable to develop the property
without the Variance due to the physical constraints caused by the
extreme slope at the rear of the lot.
Section 3-. That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located, since the proposed deck will not impair views from
neighboring properties and will be built according to Building and
Safety standards.
Section 4: That'the granting of such a Variance will not be
contrary to the objectives of the General Plan since the
residential use of the property will not be altered by the
addition of the deck. The property is not located within the
Coastal Specific Plan District.
Section 5: For the foregoing reasons and based on the
information and findings included in the Staff report and records
of the proceedings, the Planning Commission hereby approves
Variance No. 289 subject to the conditions contained in Exhibit
"A" attached hereto and made a part hereof , which are necessary
to preserve the public health , safety, and general welfare in the
area.

Conditions of Approval
for Variance No. 289
1, The height of the new deck shall not exceed 12 feet as
measured from grade adjacent to the lowest foundation to the
top of the deck's handrail.
2. The applicant shall landscape that portion of his property
immediately adjacent to the base of the new deck area to
provide screening relief. The applicant shall submit a
landscape plan to the Environmental Services Department for
review by the Director of Environmental Services.
3, The applicant shall modify the submitted plans to include
adequate fencing height for the spa. The applicant shall
provide a minimum fence/gate height of 5 feet, maximum fence/
gate height of 5 feet, with self latching and self locking
gates,
