A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 283
FOR THE INSTALLATION OF SUPPORT POLES AND A REAR
PATIO STAIRWELL WHICH EXCEED THE CITY'S HEIGHT
LIMITATION AT 6317 VIA COLINITA.
WHEREAS, Mr. Frederick Kearns has requested a Variance to
allow support poles and a rear patio stairwell whose maximum
height will be 27 feet, and therefore exceed the City's height
limitation; and
WHEREAS, after notice issued pursuant to the provisions of
the City's Development Code, the Planning Commission held a public
hearing on April 23, 1991, at which time all interested parties
were given an opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are extraordinary conditions
applicable to the subject property which do not,generally apply to
other property in the same zoning district in that the topography
of this lot includes steeply sloping areas which create difficult
circumstances regarding building height.
Section 2: That the Variance is necessary for -the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
like conditions. This variance is necessary since the degree of
the sloping lot is such that it does not enable the applicant to
install this project without exceeding the City's height
limitation requirements. The installation of support poles and
stairwell would provide access from the rear of the main level to
the lower levels of the house.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located in that the scope of the proposed construction activity is
minimal, and the design of the project will not adversely affect
surrounding views.
Section 4: That the granting of the Variance will be in
accordance with the objectives of the General Plan since the
property already exists as a single family residence. The
property is not located within any Coastal Specific Plan area.
Section 5: That the proposed construction of the stairwell
and installation of support poles meets the intent of the City's
Development Code.
Section 6: For the foregoing reasons and based on
information and findings included in the Staff Report, the
Planning Commission of the City of Rancho Palos Verdes hereby
grants Variance No. 283 for the use described herein.
