PC RES 1991-0170 P.C. RESOLUTION NO. 91-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 281, TO ALLOW REDUCTIONS OF SIDE YARD AND REAR YARD SETBACKS FOR AN AFTER -THE -FACT TRELLIS STRUCTURE AT 27011 DIAMONDHEAD LANE. WHEREAS, on January 8, 1991, the applicant, Mr. Leon Spasser, submitted Variance No. 281 to the Department of Environmental Services for processing; and WHEREAS, after notice pursuant to the City's Development Code, the Planning Commission held a public hearing on April 9, 1991, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are extraordinary conditions applicable to the subject property which do not generally apply to other property in the same zoning district in that the applicant's property is substandard in area when compared to newly created RS - 4 zoned lots, and the applicant is also limited to improving his property due to the restricted rear yard area. Section 2: Because of the substandard area of the applicant's lot and limited rear yard area, a Minor Exception Permit or Variance would be required for any significantly sized structure such as the applicant has proposed. Section 3: A view analysis has been performed by Staff to determine the impacts the structure has on neighboring properties. The existing solar panels atop the trellis structure significantly impair the Los Angeles Basin and city lights views from the viewing areas at 27019 Diamondhead Lane. Thus, the granting of the Variance to allow the trellis to remain shall be conditioned that the solar panels are removed from the trellis. Section 4: The granting of the Variance for the trellis will not change the residential use of the property and therefore is not contrary to the objectives of the General Plan. The subject property is not located within a Coastal Setback district. Section 5: For the foregoing reasons and based on information and findings included in the Staff report and evidence presented at the public hearing, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 281 as amended with this resolution and subject to the conditions of Exhibit "A" attached hereto. Resolution No. 91- 17 Exhibit "A" Conditions of approval for Variance No. 281 1) The existing solar panels located atop the trellis structure shall be removed. If the panels are to remain on the property, the applicant shall submit the appropriate application to the Environmental Services Department for approval prior to relocating them. 2) A Covenant to Protect Views shall be completed, notarized, and submitted prior to the issuance of final building permits. 3) The trees located along the applicant's west applicant shall be laced and/or trimmed to restore the views from 27019 Diamondhead Lane. 4) The applicant shall obtain all necessary permits for the trellis from the City's Building and Safety Division.
