PC RES 1991-013P.C. RESOLUTION NO. 91-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 292 TO ALLOW CONSTRUCTION OF A BAY WINDOW 8 FEET INTO THE FRONT SETBACK AND 12 FEET FROM THE FRONT PROPERTY LINE AT PROPERTY LOCATED AT 4364 ADMIRABLE DRIVE. WHEREAS, Mr. and Mrs. Greg Olton have requested a Variance to allow construction of a bay window 8 feet into the front setback and 12 feet from the front property line; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code a public hearing was held on April 9, 1991, at which time all interested parties were given an opportunity to be heard and present evidence; NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: There are exceptional or extraordinary circumstances or conditions applicable to the property which do not apply generally to other properties in the same zoning district, in that the existing structure was constructed so as to be situated at an angle on the lot so that it does not conform to required setbacks, whereas most of the Is other residences in the immediate neighborhood were constructed to conform to the required setbacks. Thus, the granting of the variance will not confer any special privileges upon the property owner. Section 2: That such a variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district because the property is zoned for single family residential development and the bay window will provide for architectural articulation of the structure. Section 3: The granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located because the bay window will not cause any view impairment or hinder vehicular visibility. Section 4: The granting of the variance will not be contrary to the objectives of the general plan or the policies and requirements of the coastal specific plan because there is no change in land use proposed and the property is not located within the coastal zone. • • • 0 Section 5: The subject property is served by sanitary sewers. • • Section 6: For the foregoing reasons and based on the information and findings included in the staff report and records of the proceedings, the Planning Commission hereby approves the request for approval of Variance No. 292 as submitted.
