RESOLUTION NO. 91-12 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 284 TO ALLOW SOLAR PANELS TO EXTEND A MAXIMUM OF 18 FEET INTO AN EXTREME SLOPE AT 7341 BERRY HILL DRIVE. i WHEREAS,, on January 23, 1991, the applicants, Mr. and Mrs. Bob Christy, submitted Variance No. 284 to the Department of Environmental Services for processing; and WHEREAS, after notice pursuant to the City's Development Code, the Planning Commission held a public hearing on April 9, 1991, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section1: That there are extraordinary conditions applicable to the subject property which do not generally apply to other property in the same zoning district in that the applicant's rear yard area is limited in size due to the location of the residence on the lot, the existing improvements, and the constraining ascending, extreme slope at the rear of the property. Section 2: Due to the physical restraints caused by the nature of the property, a Variance is necessary in order to preserve a substantial property right of the applicant, which right is possessed by other property owners under like conditions. Section'3: That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located because there is no possibility of potential view impairment caused by the solar panels due to their location and the physical characteristics of the area. Also, Staff has performed an,anylitical survey of the applicant's property, and has concluded that the panels will not be visible from the public right-of-way. Section A.- That the granting of the Variance will not alter the residential use of the property and therefore will not be contrary to the objectives of the General Plan. The property is not located within any Coastal Specific Plan district. Section 5: For the foregoing reasons and based on information and findings included in the Staff report and evidence presented at the public hearing, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 284 for solar panels to be extended a maximum of eighteen (18) feet into an extreme slope at 7341 Berry Hill Drive, subject to the conditions contained in'Exhibit "A", attached hereto. Resolution No. 91-12 Page 2 411 111 Exhibit "A" Conditions of Approval for Variance No. 284 1) Solar panels shall be located a maximum of eighteen (18 ) feet from the toe of the extreme slope, and centered as appropriate on the slope as determined by Staff. 2) Solar panels shall not be located in such a manner so as to disturb the existing drainage swale located on the slope. 3) Solar panels shall constructed as indicated on the submitted plans. 4) Solar panel material shall be of non-reflective material only. 5) All necessary building permits shall be obtained from the City' s Building and Safety Division. 6) Screening foliage shall be located along the applicant' s eastern property line, towards the rear of the property. A landscape plan shall be submitted by the applicant for approval by the Director of Environmental Services. P.C. Resolution No. 91- 12 Page 3
