RESOLUTION NO. 91-11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES ADOPTING THE NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 619 AND APPROVING CONDITIONAL USE PERMIT NO. 132 -REVISION "A" TO ALLOW THE DISCOVERY WORLD INFANT CENTER AND PRESCHOOL TO USE PORTIONS OF THE EXISTING MIRALESTE ELEMENTARY SCHOOL SITE FACILITIES AT 6245 VIA CANADA WHEREAS, on November 6, 1990 Ms. Sheryl Austin submitted an application on behalf of the Palos Verdes Peninsula Unified School District requesting that the Discovery World Infant Center and Preschool be allowed to use portions of the existing vacant facilities at the Miraleste Elementary School site; and WHEREAS, after reviewing the proposal, Staff determined that the project was not exempt from the requirements of the California Environmental Quality Act ("CEQA") and requested that the applicant complete and submit an Environmental Assessment; and WHEREAS, on February 25, 1991, Staff completed an Initial Study of the project and determined that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures have been added to the project which mitigate all potential Impacts to a level of insignificance; and WHEREAS, after notice pursuant to the City's Development Code, the Planning Commission held a public hearing on March 26, 1991, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The granting of this revision to Conditional Use Permit No. 132 will not cause any significant adverse environmental impacts on adjacent properties or other permitted uses on the site because the approval of this project has been conditioned to mitigate any adverse impacts. Section 2: The project will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code because the project will be utilizing existing vacant school facilities. Section 3: The site is adequate in size and shape to accommodate the proposed use. • Section 4: The site for the proposed use relates to streets and highways properly designed to carry the type and quantity of traffic generated by the proposed use in that the site is bounded by Palos Verdes Drive East, Via Canada, and Picardie which are public streets and there are a total of 48 parking spaces available on-site. Section 5: The proposed use is not contrary to the General Plan. Section 6: Portions of the existing grass playing fields could be fenced without causing impacts to other existing permitted uses on the site. Section 7: For the foregoing reasons and based on the information and findings included in the staff report and records of the proceedings, the Planning Commission hereby adopts the Negative Declaration for Environmental Assessment No. 619 and approves Conditional Use Permit No. 132 -Revision "A" subject to the conditions of approval in Exhibits "A" and "B" which are necessary to protect the public health, safety, and welfare. Resolution No. 91-11 Page 2 EXHIBIT "A" CONDITIONS OF APPROVAL ENVIRONMENTAL ASSESSMENT NO. 619 CONDITIONAL USE PERMIT NO. 132 -REVISION "A" MIRALESTE ELEMENTARY SCHOOL 6245 VIA CANADA Within thirty (30) days of this approval, the applicant and the landowner shall submit, in writing, a statement that he/she has read and understands all conditions of approval. Failure to provide such a statement shall render this approval null and void. 2. All conditions shall be complied with and maintained in a good faith effort from the applicant. This approval may be suspended by the Director of Environmental Services if found in non-compliance with any of these conditions of approval. 3. The proposed revision to Conditional Use Permit No. 132 is valid for six (6) months after initiation of operations. The applicant may request that the Planning Commission extend this permit prior to its expiration. 4. The sand box/tot lot and grass play area adjacent to the sand box/tot lot may be fenced in accordance with the diagram attached in Exhibit "B". Fencing shall be the minimum height required by the Division of Building and Safety. Any gates which provide access to this area may be closed and locked by the applicant when not in use until such time as a member of the public requests that the facilities remain open for public use. If such a request is made, the Director of Environmental Services shall review the request and may require the gates to remain unlocked at all times to allow for public access to the play area. 5. The applicant shall submit for review and approval by the Director of Public Works a comprehensive plan detailing the circulation pattern for pick-up and drop-off of students. 6. A limit on the number of students enrolled in the Discovery World center shall be established so that the number of parking spaces required for the use does not exceed 17. This number shall be established based on State requirements for student to teacher ratio, and shall include allowances for a minimum of 5 loading spaces. If a change in the existing uses on the Miraleste Elementary School grounds occurs which causes additional parking spaces to be available, the applicant may submit a written request to the Director of Environmental Services to increase the level of enrollment. Based on State requirements for teacher to student ratios, the applicant shall provide calculations indicating the total proposed enrollment on the site with separate figures provided for both the number of infants (0-2 years) and preschool (2 years and older) students to the Director of Environmental Services. Applicant shall also indicate the number of teachers and teachers aides that will be employed on site. 8. In order to decrease the number of drop-off and pick-ups of students, the applicant shall work with all of the parents of enrolled students as well as employees to encourage carpooling wherever possible. 9. The applicant shall comply with all recommendations and requirements, if any, of the Division of Building and Safety. 10. The proposed plans shall be reviewed by the Fire Department to verify that adequate fire alarm systems are available on the site. 11. The applicant shall supply a copy of the license provided by the State Department of Social Services Community Care Licensing Agency indicating compliance with all State requirements and authorizing the operation of the Discovery World center on this site. 12. The applicant shall install adequate communication systems on the site in case of emergency. 13. No additional parking shall be permitted for any new or existing uses on the site before 12:00 p.m. daily. Any proposed increases in the number of vehicles to be parked on the site after 12:00 p.m. shall be cleared by the Director of Environmental Services prior to the change. 14. Unless the Department of Fish and Game determines that this project is exempt from a filing fee imposed pursuant to Fish and Game Code Section 711.4, the applicant shall submit to the City payment of such fee made payable to the County Clerk of Los Angeles, along with the County's documentation fee, not later than 48 hours after project approval. The applicant shall also be responsible for payment of any fines the Department of Fish and Game determines to be owed. Project approval is not operative, vested, or final until the filing fees are paid or a Certificate of Fee Exemption is properly completed. A minimum fee of $25.00 for documentation handling shall be submitted to the City within 48 hours of project approval for processing of the Certificate of Fee Exemption (De Minimus Impact Finding).
