A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 285 AND GRADING NO 1517 FOR
GRADING AND CONSTRUCTION OF A NEW SINGLE
FAMILY RESIDENCE AT 19 AMBER SKY DRIVE.
WHEREAS, on January 15", 1991, the applicant's
representative, Mr. Jay Stasack, submitted Variance No. 285 and
Grading No. 1517 to the Department of Environmental Services for
processing; and
WHEREAS, on March 12, 1991, revised applications were
submitted for both the Variance and Grading requests which were
recommended by Staff; and
WHEREAS, after notice pursuant to the City's Development
Code, the Planning Commission held a public hearing on March 26
1991, at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section l: That there are extraordinary conditions
applicable to the subject property which do not generally apply to
other property in the same zoning district in that less than one
quarter of the available land is level, developable property due
to the various transitional, extreme slopes located throughout the
lot.
Section 2: That the Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant, which right is possessed by other property owners under
lake conditions since the physical restraints caused by the nature
of the property do not enable the applicant to develop the
property to its full potential without the granting of the
Variance. The applicant does not enjoy the right to develop the
property with a true two story structure because of the potential
views impacts to the neighbor located immediately north of the
applicant's property.
Section : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located because the scope of the construction activity which is to
occur within the extreme slope areas is minimal, and views from
adjacent properties will be protected with the proposed design.
Section 4: That the granting of the Variance will be in
accordance with the objectives of the General Plan since the
property will be developed as a single family residence. The
property in not located within any Coastal Specific Plan area.
Section 5: That the revised grading figures are acceptable
quantities with respect to the Development Code's grading
standards since the total volume of earthwork has been
significantly reduced from the original proposal and represents a
more balanced quantity because of the reduced amount of cut and
the scope of the required compaction/recompaction work that will
occur.
Section 6: For the foregoing reasons and based on
information and findings included in the Staff report and evidence
presented at the public hearing, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 285 and
Grading No. 1517 for grading and construction of a new single
family residence at 19 Amber Sky Drive subject to the conditions
contained in Exhibit "A", attached hereto.

EXHIBIT "A"
CONDITIONS OF APPROVAL
FOR VAR. NO. 285 & GR. NO. 1517
1) Maximum allowable grading shall not exceed a total volume of
627 cu. yds. of earth movement.
2) Maximum height of the proposed single family residence shall
not exceed a height of 16 feet as measured pursuant to the
Development Code.
3) Minimum required setbacks shall be maintained: 20'-0", front
yard; 5'-0", side yards; 15'-0", rear yard.
4) A Covenant to Protect Views shall be completed, notarized, and
submitted prior to the issuance of final Building permits.
5) Maximum eave projections shall not exceed 4" for each 1'-0" of
required setback.
6) The applicant shall maintain a minimum of 50% landscaping
within the required front yard setback area.
7) Minimum 5'-0", maximum 6'-0" pool fencing and self latching/
self locking gates are required.
8) Pool equipment shall be located a minimum of 3 feet from any
property line.
9) Maximum height of pool equipment enclosure shall not exceed a
height of 78 inches.
10) A landscape plan shall be submitted for review and approval by
the Director of Environmental Services, with a minimum of 80%
of the plantings to be drought tolerant.
