A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
THE APPEAL OF HEIGHT VARIATION NO. 663 -REV.
AND MINOR EXCEPTION PERMIT NO. 365 REV.
THEREBY APPROVING THE PROJECT AT 4714
BROWNDEER LANE.
WHEREAS, on July 23, 1990, the Director of Environmental
Services administratively denied the requests to add onto the
first and second levels of the residence and for encroachments
into the setbacks at 4714 Browndeer Lane; and
WHEREAS, on December 20, 1990, the Director of Environmental
Services administratively denied the applicant's revisions to the
original requests; and
WHEREAS, on January 10, 1991, within 15 days of the
Director's decision, the applicant, Ms. Eleanora Witteles,
submitted an appeal of the Director's decision to the Planning
Commission; and
WHEREAS, after notice pursuant to the City's Development
Code, the Planning Commission held a public hearing on March 12,
1991, at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That pursuant to Section 17.02.040 of the
Development Code, the applicant has complied with the provisions
set forth for early neighborhood consultation, in that she had
obtained a sufficient number of signatures from those property
owners within a 500 foot radius from the subject property
to satisfy the requirement.
Section 2: That the applicant constructed a temporary space
frame of the outline of the proposed addition, the height and
location of which were verified by Staff.
Section 3: That the structure does not significantly impair
a view or vista from public property (parks, major thoroughfare,
bikeway, walkway, equestrian trail etc.) which has been identified
in the City's General Plan, Coastal Specific Plan, or City
approved viewing area.
Section 4: That the proposed structure is not located on a
ridge or promontory.

Section 5: That due to the nature of the topography of the
area, there are no properties from which the proposed structure
will cause any view impairment. The Planning Commission finds
that there are no identifiable views enjoyed by the residents of
this canyon -like area of the City.
Section 6: That granting approval of the revised project
would not cause a significant cumulative view impairment since
there are no views which would be impacted.
Section 7: That, when considered exclusive of existing
foliage, granting approval of the revised project would not cause
significant view impairment from the viewing area of another
parcel since it has been determined that there are no views which
will be impacted by the proposed project.
Section 8: That, because of the substandard lot size, and an
existing nonconforming structure (pool), the Minor Exception
Permit for the encroachment of a portion of the new structure
three (3) feet into the street side yard setbacks can be
justified.
Section 9: That the proposed structure complies with all
other Code requirements.
Section 10: That based upon photographic analysis of the
vicinity, the proposed structure is compatible with the character
of the immediate neighborhood. The architectural style and
building materials are consistent with existing structures. The
proposed first and second story additions will be similar in scale
and mass to other multi-level residences in the area.
Section 11: For the foregoing reasons and based on
information and findings included in the Staff report, minutes and
evidence presented at the public hearing, the Planning Commission
of the City of Rancho Palos Verdes hereby approves the appeal of
Height Variation No. 663 -Rev. and Minor Exception Permit No. 305
Rev., thereby overturning the December 20, 1990 decision of the
Director of Environmental Services to deny the requests, and
approving the redesigned proposal subject to the conditions
contained in Exhibit "A", attached hereto.
APPROVED, and ADOPTED this 26th day of March, 1991.

EXHIBIT "A"
CONDITIONS OF APPROVAL FOR
H.V. #663 REV. & M.E.P. #365 REV.
1) Maximum height of the second story addition shall not exceed
21'-0" as measured pursuant to Section 17.02.040.
2) Minimum required setbacks shall be: 20'-0", front yard; 5'-0",
side yard; 15'-0", rear yard; 12'-0", street side yard.
3) Maximum height of pool enclosure wall shall not exceed 6'-0".
4) A Covenant to Protect Views shall be completed, notarized, and
submitted prior to the issuance of final Building permits.
5) Maximum eave projections shall not exceed 4" for each 1'-0" of
required setback.
6) A landscape plan shall be submitted for approval by the
Director of Environmental Services.
