PC RES 1991-003P.C. RESOLUTION NO. 91 -3 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 279 FOR A SATELLITE DISH ANTENNA TO REMAIN WITHIN THE INTERSECTION VISIBILITY TRIANGLE AND AN EXISTING WALL TO EXCEED THE 6 FOOT HEIGHT LIMIT AND APPROVING A 30' HOSE TOWER AT 83 MIRALESTE PLAZA. WHEREAS, the Los Angeles County Fire Department has requested a Variance to allow an existing satellite dish antenna to exceed the 30 inch height limit within the intersection visibility triangle at the corner of Palos Verdes Drive West and Miraleste Drive and an existing 6'10" masonry wall to exceed the 6 foot height limit and has requested approval for a 29'9" high hose tower to exceed the 12 foot height limit. WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on January 8, 1991, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property since the lot is triangular in shape, abuts public streets on all three sides, and there is a substantial grade differential between the developable pad and the street level of Palos Verdes Drive East and Miraleste Drive. Section 2: That a Variance is necessary to preserve or allow the enjoyment of a substantial property right of the applicant which is possessed by other property owners under similar conditions in the same zoning district, since the variance is necessary to provide an appropriate location for the satellite dish antenna to receive training broadcasts from the Federal Emergency Management Agency (FEMA) and the wall will provide an added safety barrier to an unseen grade drop on the property. Section 3: That the granting of the Variance will not be materially detrimental to the public welfare and injurious to property and improvements in the area in which the property is located, since the satellite dish antenna will not interfere with the traffic sight lines at the intersection and the wall will provide safety for pedestrians using the sidewalk along Miraleste Drive. Section 4: That the Variance is not contrary to the provisions of the General Plan since the satellite dish antenna and wall will enhance the function of the fire station which provides necessary emergency services identified in the Safety Element of the General Plan. Section 5: That the proposed hose tower will not significantly adversely affect views or values of adjacent properties in that the tower will be only 1 - 2 feet higher then the existing ridgeline of the Fire Station, would be constructed out of metal pipes in a manner that would minimize view obstruction, is partially screened from view by existing vegetation and does not impair any views from surrounding properties. Section 6: For the foregoing reasons and based on information and findings included in the staff report, minutes, and evidence presented at the public hearing, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 279 and allows placement of a 2919" hose tower subject to the conditions of approval attached in Exhibit "A". Resolution No. 91-3 Page 2 VARIANCE NO. 279 Exhibit "A" 1. All on-site parking requirements approved through Conditional Use Permit No. 137 shall be maintained. 2. The color of the hose tower is subject to the approval of the Director of Environmental Services prior to painting. 3. The applicant shall submit a landscape plan for screening the existing satellite dish antenna and the proposed hose tower from adjacent streets.
